Get a lawyer. If you know she is driving like that, call the cops so she gets charged with a DUI. Only way to use it in family court. Trap her as much as possible.

In my experience, if she isn’t arrested for it the courts won’t care. Especially if she doubles down on excuses or acuses you of things.

Get a lawyer.

unless she gets arrested, not much can be done unless she's stupid and allows you to leverage it - keep a record of it, and everything else she does so you can potentially establish a pattern of putting the kids in danger

Use it as leverage to get her to do things, but chances are it will cost you money, time and may piss her off more if you take further action...and absolutely nothing good will come of it.

There is what should be and what is. Play the end game, not the petty short term back and forth.

Here’s my experience with the same thing during my divorce in California. Hopefully it doesn’t go the same way for you but I think there are some lessons from it…

My ex was a stay at home mom and is an alcoholic. She started going out at night, leaving the kids with me and not coming home until after 2am. The straw that broke me was the first day of soccer practice and I had left work early to make it to practice. She was an hour late and slurring her words when she arrived with the kids with no explanation for where she had been and why she was late.

I called the police on her but by the time they arrived she had driven home and gone inside. The police wrote up a report that she was drunk but not driving so not arrested. They took her to a friends house to “sleep it off” and left the kids with me.

During the divorce I produce a bunch of evidence showing that she no showed for visitations repeatedly, and that the kids (7 and 9) telling me that mom was drinking and driving erratically with them in the car.

The court ordered us to both see an “alcohol abuse specialist” who costs $6000 cash only payment up front. They also ordered CPS to interview us.

When CPS interviewed her she provided fake evidence that I hit my kids and yell to punish them. That they are scared of me and that she filed for divorce to get away from me. When CPS interviewed me they were not interested in the drinking at all and only wanted to hear about how i discipline the kids (Which i don’t at all almost to a fault. I’m too easy going).

She filed for a restraining order against me at the same time and kidnapped the kids to go up north to stay with her affair boyfriend (while telling the court she was in a domestic violence shelter).

It cost me an extra $30,000 to fight the domestic violence allegations and get my visitation back.

The court did not for one second give a single shit about the drinking and driving allegations.

My divorce cost me $75,000 over two years of fighting to get 50/50 custody and force her to move out of the house and sell. Her boyfriend moved into my house for years but kept his NorCal address so she wouldn’t lose alimony.

I finally got 50/50 and she still doesn’t work 7 years later. I’m still paying her $2200 a month and have another 4 years to go before my youngest turns 18.

The moral of the story is that you should consider if you have the cash to ask the court care about this issue. Also that you will poke the bear. Women respond severely when their identity as “mom of the year” is threatened.

My ex eventually got dumped by mr wonderful. She’s living in a crappy apartment and I have a beautiful new home. She finally got sober last year and goes to AA a lot now.

I have a new home. A nice long term girlfriend with no kids and her own paid off house in palm springs. A new RV. A couple new cars. I started a business after the divorce to keep myself busy when the kids were gone and it got me a new full time job making double what i made before. Working from home full time and play golf 3 times a week. I have my kids at least half of the week and am at every volleyball game and most practices.

Life is good now!
