if you are so stupid to file for divorce AFTER you have won the lottery, you can not really blame someone other than yourself.

higher difficulty: the divorce will be completed by tuesday, I'll win the lottery on friday

Marriage: Not even once

After doing it twice, and divorcing twice, that is what I should have been thinking 25 years ago.

This illustrates a problem with family law in general. Nothing gets looked at on a case-by-case basis, i.e., how much does it really cost to raise a kid, was that guy already separated for several years with the couple maintaining separate/individual assets, etc.

I know a guy who has a decent stock portfolio -- signed over to him by his grandfather when he was two and he's in his 30s now. He's never touched it or comingled it with joint assets, but when he got divorced, it was determined that when this stock paid dividends (which were all reinvested automatically), those dividends were declared on their joint tax return, so they jointly paid a few hundred bucks in income tax over the years.

That means the stock portfolio was joint property, and she got half of its value. The wife didn't even work for the majority of their marriage.

It was his fault for not talking to a professional prior to the marriage. You have to put that shit in a trust, or just not get married.

[–]TRP VanguardArchwinger 32 points33 points34 points 12 years ago (3 children) | Copy Link

Yeah. Normal, non RP people have this crazy idea that they've met the right girl and are going to settle down, have kids, and raise a family together for the rest of their lives.

Then, oops, their wife wants them to gradually change a few things...you know, for the family. Then, oops, they're not having sex any more. Then, oops, one of them is, and it's not the husband, but it's definitely the husband's fault that it happened, for working too hard to support the family and being so emotionally distant from the nagging roommate that's not having sex with him.

As they have their rose-tinted glasses on, they believe they'll be treated fairly (with reason, logic, that kind of stuff) by their wives when love dissipates...

... and usually they & their wallets are in for quite a ride.

The worst part: those glasses sometimes stay intact.

[–]2 Senior Endorsed Contributorvengefully_yours 0 points1 point2 points 12 years ago (1 child) | Copy Link

Partly rose colored glasses, partly simple inexperience. After getting fucked over by a divorce a man will see things very differently, but will still hope there is a good womanTM out there somewhere, and he might think he has found her.

The biggest mistake is assuming women love you, when really they only love what you do and provide for them. I honestly believe they are wholly incapable of loving the way we are, except for their children, and even then its not all of them that love their kids. You only need to look at the abuse stats to see women are far and away the largest abusers of children.

a brofist here. you materialized my thoughts.

[–]throwaway-o 1 point2 points3 points 12 years ago (0 children) | Copy Link

We really need to stop saying "it's the victim's fault" for byzantine surprise shit that they couldn't have possibly known. Yes, I know that one of the most important dogmas of statism is that "ignorance of the law is no excuse". That dogma is full of shit, and it's about enough that we let this lie divide decent people into victims and blamers.

[–]Ididerus 3 points4 points5 points 12 years ago (1 child) | Copy Link

IANAL

I'd tend to agree with the ruling in this case, he did nothing to overt the impression that the portfolio was a joint asset, in fact he moreover explicitly defined it as an asset to the marriage by paying joint-filed taxes on the dividends. She should be entitled to half the value earned during the marriage period.

RPBallin has the right of it, any assets of significant value you wish to protect (be it from vexed women or identity thieves, etc.) should be placed in trust or at the least an annuity. Real assets can be handled by other means, or carried on a balance sheet somewhere else. Making a woman understand the need to protect financial interests and that wealth is not merely a means to her new Mercedes is another matter entirely.

[–]3trplurker 0 points1 point2 points 12 years ago (0 children) | Copy Link

If anyone is crazy enough to get married they need to talk to a lawyer first and foremost. Get a prenup but also ensure she has her own independent legal representation to give her counsel about the prenup. Always keep all premarital assets separate, even if it means paying more taxes in the long run.

Now I'm not suggesting this as a solution but ... professional "problem solvers" aren't nearly as expensive as the movies make them out to be.

[–]destraht 1 point2 points3 points 12 years ago* (3 children) | Copy Link

The barely-rich and the middle class are not so wise when it comes to money. All of this should have been in a trust with an offshore element. There are solutions for this stuff people and it so damn common that it comes in a package at an industry set competitively priced point.

People get fucked over because they are practicing peasant banking.

[edit] So I think that once a woman shares 20-25 years of her life with me and producing some children then I will really consider breaking her into any old family wealth. Until then she is probationary family member. Until then I would only set her up with enough resources to not have to freak out and to become desperate if I suddenly died.

Why not just put her in your will... ?

[–]destraht 0 points1 point2 points 12 years ago (0 children) | Copy Link

Same thing.

[–]3trplurker 0 points1 point2 points 12 years ago (0 children) | Copy Link

Why not just put her in your will... ?

Cause you can get royally fucked over in divorce court. It's shitty but they can decide that she's entitled to 50% of whatever assets are prescribed to her in your will, possibly even forcing you to keep her in your will even if you get remarried. Most divorce courts are looking for ways to award her more money, provide them with as few excuse's as possible.

[–][deleted] 1 point2 points3 points 12 years ago (3 children) | Copy Link

Prenuptial agreement . If you love me, you arent marrying me for my shit.

[–][deleted] 0 points1 point2 points 12 years ago (2 children) | Copy Link

Prenups aren't necessarily upheld

[–][deleted] 1 point2 points3 points 12 years ago (1 child) | Copy Link

Seriously? Then what is the point of signing one...

[–][deleted] -1 points0 points1 point 12 years ago (0 children) | Copy Link

It depends on the context. They're usually meant to protect BUSINESSES, not personal assets

[–][deleted] 5 points6 points7 points 12 years ago (0 children) | Copy Link

Fuck that shit. I'd take my fat winnings and leave the country. That's just fucking ridiculous.

"...living apart for eight years but were not yet divorced..."

What an idiot.

Friends don't let friends get married.

[–][deleted] 1 point2 points3 points 12 years ago (0 children) | Copy Link

Reminds me of a friend who went bankrupt and had his wife leave him. She knew he was a bit of a baller, and only divorced him after he made back 10's of millions of dollars in a new business venture. I assume for the whole time he thought they could reconcile.

[–]NegativeX 2 points3 points4 points 12 years ago (0 children) | Copy Link

Not ex-wife, technically she's still the wife.

[–]Florist_Gump 0 points1 point2 points 12 years ago (4 children) | Copy Link

Curious why in the world either side let a separation linger on for 8 years. Thats just goofy for both.

It sounds incredibly crappy for the guy but... not divorced yet means not divorced yet, legally she is entitled to some of marital property which the lottery winnings became.

[–]jolly--roger[S] 4 points5 points6 points 12 years ago (3 children) | Copy Link

Well, that's where the 8 years of estrangement should come in. 8 seconds or 8 years, blue pill judges don't see a difference.

[–]Florist_Gump 0 points1 point2 points 12 years ago (2 children) | Copy Link

IMO "blue pill judges" doesn't come into the equation here, judges of all flavors aren't big on customizing laws on a case by case basis. Should they? Yes. Do they? Not too often, no, on all sorts of issues not limited to blue/redpill topics. The whole point of law is to provide a commonality.

I'm not saying I agree with the situation at all but the male separatee here shoulders at least as much blame in letting a bad situation linger.

[–]jolly--roger[S] 0 points1 point2 points 12 years ago (1 child) | Copy Link

and he does. in my eyes, this is a combination of a BP guy (not divorced for 8 years = dude, wtf?) and a BP court (8 years of estrangement = pay up anyway, including all the fees)

[–]parkitmister 0 points1 point2 points 12 years ago (0 children) | Copy Link

Were not yet divorced. If the law says "must be divorced", it's not blue pill judges, it's an idiot husband, imo. Estrangement doesn't matter for shit legally, and it's Germany, so laws are supreme.

[–]throwaway-o 0 points1 point2 points 12 years ago (0 children) | Copy Link

Teutsche Scheiße.

[–]parkitmister 0 points1 point2 points 12 years ago (0 children) | Copy Link

They were still married when he won. Unless they had a prenup saying "mine is only mine" she was there still, whether they were living apart or not.
