Judging from the reports of more reliable sources than Brietbart, it seems like the guidelines are intended to get police to question whether the person was inebriated or if the supposed offender knew of any mental vulnerability, and that the many inferences that Brietbart are making about the handling of cases beyond questioning methods and attitude are unfounded, especially given that if you check the CPS website, the CPS Policy for Prosecuting Cases of Rape hasn't changed since 2012. The new action plan doesn't seem to be changing the burden of proof at all, it seems to be mostly aimed at assuaging the fears of people who think their behaviour will affect whether the police will listen to what they have to say ('An effective strategy in the investigation and prosecution of many cases requires a focus on the actions of the offender, rather than those of the victim') (that's a link to the new document in question, the 'Joint CPS and Police Action Plan on Rape,' if you want to check it out.)

There's plenty to complain about in the UK approach to sex crimes (the gendered nature of that approach being the most prominent,) but I think this is a non-issue personally.

Wow that was blatant lie on their part i thought they had done a bit more than a advocacy change. didn't know brietbart was so full shit. Well fuck. All that rage over nothing. oh well

I don't blame you at all for thinking that, a few places seem to be running with their interpretations of Saunders' statements and assuming it's a formal change to the burden of proof rather than guidelines from an action plan on questioning and things like that. I actually consider this announcement a step in the right direction because it starts with 'Rape and sexual abuse against women, men and children,' whereas a lot of the CPS stuff from the main website is phrased as for 'women and children.'

I'd say there'll probably be a clarification from the CPS in a couple of days though since there seems to be a lot of confusion.

Very respectable reaction.

[–]namae_nanka1 point2 points3 points 11 years ago (8 children) | Copy Link

Everyone is reporting it as a 'yes means yes' nonsense that went down in California last year.

[–]Sansa_Culotte_3 points4 points5 points 11 years ago (7 children) | Copy Link

Well, not everyone. Just those who can't be arsed to do their own research.

[–]namae_nanka0 points1 point2 points 11 years ago (6 children) | Copy Link

Even the bbc article says,

The law already states consent must be given fully and freely, but the new guidance instructs officials to look at the whole context of a rape allegation.

And as for the other woman whose remarks are being used for those headlines, wouldn't be the first time someone would rather not popularise it the way it's meant to be enforced.

And as for the other woman whose remarks are being used for those headlines, wouldn't be the first time someone would rather not popularise it the way it's meant to be enforced.

I assume that by "someone" you mean "Breitbart's team of right-wing pundits".

[–]namae_nanka1 point2 points3 points 11 years ago (4 children) | Copy Link

That would be good assumption if they were responsible for the monstrosity that is Title IX today.

[–]Sansa_Culotte_0 points1 point2 points 11 years ago (3 children) | Copy Link

Last time I checked, the OP has nothing to do with "Title IX"

[–]namae_nanka0 points1 point2 points 11 years ago (2 children) | Copy Link

Women don't really believe in their own agency. Otherwise, they'd consistently act in a way that affirmed it.

They would take responsibility for their own safety to a bare minimum of reason, instead of ascribing any criticism or advice as victim-blaming. They would not place sole responsibility of ascertaining their consent to be on their partner either. They would not consider themselves raped instead of the rapists when one of two inebriated partners. They would, as a cause, support equally strict punishment of women for same crimes instead of fabricating nonsense like the pay gap and demanding that industry fix it for them. They would adapt to or create institutions instead of demanding inclusion having done nothing to earn it.

Women just want to look like they have agency. Because its cool to have it and embarrassing to not.

[–]FleetingWishStepford Girl0 points1 point2 points 11 years ago (2 children) | Copy Link

They would stop begging men to let them into their clubs, and start creating their own clubs. A woman who thinks that men are keeping them out of jobs, politics, college, etc, is a woman who believes that women can't create things.

Yeah, same thing with black people whining about racism :/

LOL!

[–]Sansa_Culotte_1 point2 points3 points 11 years ago (5 children) | Copy Link

Gotta love how the usual TRP brigade resorts to reflexive circlejerking without so much as checking the source of that "news" article.

[–]M_rafayCrimson Red2 points3 points4 points 11 years ago* (2 children) | Copy Link

Providing counter-arguments is your job.

This is how debates work. Have you ever been to one? Or seen one on TV? They usually do it for a lot of important issues. In school, it was even mandatory for us. I mean, I've long given up on expecting debate or calling for standards on PPD, but I didn't think we'd get this low; BP patting themselves on the back for a rebuttal.

Btw, this same news is making the rounds on TwoX and other reddit subs long before here. You might wanna carry your rebuttal over there as well. Hell, its been reported on from this angle on TV. I'll reserve judgement until I see something concrete.

[–]Sansa_Culotte_0 points1 point2 points 11 years ago (1 child) | Copy Link

Yea, you sound exactly like a guy who got his idea on how a debate works from TV duels.

[–]M_rafayCrimson Red1 point2 points3 points 11 years ago (0 children) | Copy Link

Maybe in america they're arbitrary affairs, but here, political debates are extremely srs bsns. and lots of people watch.

if you have parliament, you should watch the proceedings sometime. The discipline, concentration, passion and focused purpose is honestly eye-catching sometimes.

[–]Villaintine╰▄︻▄╯1 point2 points3 points 11 years ago (1 child) | Copy Link

So rather than actually discussing something we should do it the blueper way and just discredit the source? Way to kill discussion.

Don't argue with her, she is a troll.

[–]We_Are_LegionAutumn Red0 points1 point2 points 11 years ago* (0 children) | Copy Link

All this time, the TRP has been unfairly receiving the credit for saying "women are children".

That honour belongs to England.

[I acknowledge this was a misunderstanding, but eh, I'mma stick to my statement]

All of this would be solved if the world went back to how it was always supposed to be--if "consent" was merely an arrangement from a lovely lady's father to you, promising him 24 goats in exchange for his daughter's maidenhood. O how I miss the times of yesteryear! Five hundred years too late I was born...tips trilby
