So this happened about 4 years ago in Brooklyn NY. My father is in his early 80's and is a landlord who owns a small multifamily building. My dad always wanted to sell it, but my mom insisted that he keep it. Her reasoning is that he has nothing else to do but manage the property and if sold he will stay at home and just waste away doing nothing.

One day while I was at work, I got a call from my dad telling me that he's at the police station and to come and get him. I drove there right away and they said that they will keep my father there overnight till he can see a judge in the morning. My mom was away in Florida at the time and had no idea what was going on.

Turns out that one of his apartments is occupied by a family that has a 12 year old girl. The 12 year old girl has accused my father of sexually assaulting her. I got a lawyer right away and by morning my father pleaded not guilty and sent home with a trial date pending.

The accusation by this 12 year old were impossible to believe. She claimed that my father knocked on the door and she opened the door. Once the door was unlocked he forced himself inside the apartment by pushing the door open. Then he picked her up and threw her against the wall. She was disoriented and he had his hands all over her.

As I mentioned, my father is in his 80's. He walks with a gait and has a non-essential tremor. He is very very frail and does not have the strength to pick up my 3 year old, much less lift a 12 year old girl and throw her against the wall. My father is 5'2" and thin.

During the trial the girl was represented by 2 female attorneys working for the state and out for blood. They wanted to get that evil landlord thrown in jail for life. The girl was treated by the psychiatrist at her school who provided a long clinical analyses of the damage that this has done the girl and recommended a life long treatment. The girl got on the stand and was shaking and crying. She was 13 or 14 now but looked younger. One of her lawyers was visibly moved and you can also tell that the judge (a female) was very concerned about this girl.

It was basically her word against his. He had to prove that nothing happened. He had to prove a negative. The girls mother cried and screamed at court and the 2 rabid lawyers promised her that my father would be locked up for a very very long time.

My family and I were behind my father 100% because we believed every word he said and we knew there was no way he was capable of anything remotely that violent. During the trial period my father has aged 10 years. He looked more frail than ever before.

Our attorney asked her if she remembered the day that the attack occurred and she stated that it was on on September 8th. He asked her if she was certain and she is 100% certain. He asked her how she could be so certain and she said that it was 1 day before the start of the school year. Therefor she has no doubt.

We went home fearing the worse. Then we realized that during that period my father and mother were out of the country. My parents don't know how to use a computer to purchase travel tickets and always ask us to order for them. We remembered that 2 years ago they asked us for tickets leaving the country late August and come back late September. We called our lawyer right away with the news. We were able to obtain a copy of the itinerary of their vacation.

Our lawyer called her lawyers and broke the news. They said that they will confirm and if true, drop the case. The next day at court the 2 attorneys stated that they confirmed with homeland security and indeed my father has been out of the country for the majority of the month of September. The case was dropped and the family moved out of my dads building overnight.

That 12 year old girl was coached by her family to cry and shake and make up all these lies. My dad's life would have been over and his assets liquidated to support this girl throughout her life.
