Oh I didn't get convicted, which is good because the person who accused me of rape was a 15 year old girl. I am 10 years older than her. I would have been screwed had I not told investigators "Why don't you look at our message history and see if there's anything suspicious? Then look through hers. If she says she deleted it, there's your evidence right there."

I don't disagree that there needs to be evidence and investigation into matters to determine guilt. I also agree that doing it years later is likely to lead to a he said/she said that legally will err on not enough evidence for a case. I agree that if there is no evidence you can't just take someone's word for it.
In this specific case, there are two issues with the rape kit piece you mentioned. One, is that rape kits were invented in the late 1970s and this occurred in the early 1980s. They were not available everywhere at the time so if she was raped that wouldn't guarantee the police actually had them. Two, the allegation is that he attempted to rape her, but not that he succeeded, which is sexual assault (don't know if there is anything like attempted rape or what not, but sexual assault is the kind of catch all). There would be no evidence to go on. Again another he said/she said.
At that point in our history, if you want to tell me that woman would have been believed over men in a case like that I'd say you are ignoring the past. I think the pendulum has swung too far in that we now seem to social convict people without doing an investigation, but we do need to make sure we take allegations seriously and not treat the potential victim like a villain.
Why do we need to treat the potential victim like a victim? That's actually part of a problem that has led to many rapes going unreported. People feel like it is their fault. They feel like they caused the attacker to do it somehow or that they are dirty or other things that make them feel ashamed. It's a dehumanizing act that can be something you just want to repress. Going to the police about it often means it will get out or at least you fear it will. Then your friends and family will know you were raped. That can be a terrifying thing to think about when considering what to do.
Yes, if you are raped the best thing to stop the criminal is to report it immediately, but it isn't that simple psychologically. I do understand the victims plight in the matter to the best of my ability, but having never gone through it I can only imagine the internal struggle. By saying "it becomes your fault that they got away with sexually assaulting you", you are just again making them out to be the bad person. Have some fucking compasion.
Yes, if someone falsely reports a rape we should throw the book (or two) at them. We should treat them as a victim until otherwise known. We should do our job as a society and not hold either side accountable in a delicate situation until a team who is trained to investigate this type of matter has had it's time to investigate and report.
Last but not least, if she is telling the truth, why now? How about because the guy is on TV constantly right now due to the public nature of his confirmation hearing? Seeing the person again on TV could stir up memories of the past and make you realize that this person is going to hold a very important position and not doing anything gives them power to be making decisions on your life again like the time they attacked you.
Is this woman telling the truth? I have no fucking clue. There are people trained to investigate this type of thing. Let them do their job and find out. Likely, there is not enough evidence to prove either side of the story and if so then his confirmation hearing should proceed as planned. If there is evidence though, we should find out now before he gets appointed. It's a huge position and why the fuck wouldn't we take the time to make sure whoever we put in there has all their Is dotted and Ts crossed?
I know posting this in r/mgtow is going to get a lot of you heated, but maybe just maybe we can realize that due process typically does the right thing and rushing everything isn't always a great plan. Thanks for reading and hopefully a few of you don't hate me.

I'm saying legally they have the right. If you have an issue with that why not petition to change it? As it stand legally, we should let the law enforcement do their job and in situations like this they will almost for sure find there is not enough evidence to do anything with. Which is the outcome we all expect. If they find she is lying then she should be charged with a falsely reporting a crime and anything else they can stick.

Kind of related, in my country right now a man in his 50' is accused of sexual assault/murder. This part isn't a problem, since he's probably guilty, or at the very least he has a past history of it, so it doesn't help his case.
But in the last news you'll hear EVERYWHERE as an "argument" that "the women that had to talk with him always brought a man with them because theyy didn't feel good around him" and things like that. Everyone is parroting this constantly.
Breaking news, medias: 99% of women will feel this way about 80% of man. Constantly. Be it socially awkward men or even very good ones but that aren't the woman's Chad type, or just, idk, a man more used to women playing hard-to-get than the fake "nice" ones. Feelings are already not an argument when it comes to judging anyone as x/y to begin with, but when we're talking about WOMEN nowadays of all things, even moreso with the ones in their 20, it's something you must stay away from at all costs. There's a good chance that the guy is guilty in this case, but if "not getting the tingle" or "the person is too insistent" is an argument, we can immediatly put 3/4 of men in jail and that's it. This crap is ultimately too subjective to mean anything. And yet in a fucking rape/murder case they keep repeating this as if this had any value when it comes to judging whether someone is likely to commit a crime or not. #metoo isn't getting better at all, even when it doesn't say its name. Even without taking justice into account, the very fact that the fucking dean of the university bring this to the table as if it was important shows very well the problem with the whole #metoo bullshit; feelings are an absolute truth that should be used to judge in advance. And everyone is ok with this and find it normal, and the confirmation bias doesn't help. This crap will give even more momentum to this retarded way of thinking.
