Fight the relocation if your daughter is important to you. My kids live 5 hours from me and it kills me. Biggest mistake of my life.

Who told you the judge will let her move? Have you spoken to an attorney? Whatever you do, don't listen to your ex, they'll only tell you what benefits them and as far as I know, she's no lawyer.

A few things come to mind. Does she have anyone for support in Georgia? Will your child be in daycare the majority of time the ex is at work? What’s in Georgia that she can’t do in NJ?

If she’s allowed to move to Georgia, if she decides to uproot again to say California it won’t be that big of a deal in the eyes of the court.

Fight hard for it now, otherwise it’ll be impossible later.

Your argument for the kids not moving has to be framed "in the best interest of the children." Are the kids currently enrolled in school? Is there a support system in NJ that isn't available in GA? Uprooting children who are already enrolled in school, with friends, and a support system in the area to move to GA doesn't seem conducive to their best interest. Also with the covid surge in GA/FL area there could be potential health implications, another lockdown, etc. Does your ex wife already have a job and housing situation lined up? Is she going to get lifechanging money by moving to GA?

You need to draw a line in the sand here, because once your kids move to another state your fight becomes exponentially harder.

Fight the relocation - tell her and your lawyer this is a red line. I went through a relocation case in NJ - it is a very high barrier to get relocation. She has to prove this is in the best interest of the child - she (and you) would need to hire profession evaluators, prove the schooling is better, prove the jobs are better, etc. You can easily spend a hundred thousand dollars trying to prove your relocation case and most likely still lose which is why my ex eventually dropped it.

I am not sure why the Judge would be leaning towards letting her relocate - in NJ, the burden of proof is on her. Maybe your child being so young is a factor. But stand your ground! Do not be relegated to a summer parent. Divorce is a game of chicken - Judges/mediators/lawyers say things to see which side will cave first so they don’t have to go through a time consuming, complicated legal battle instead of billing you easy hours. For you, the stakes are high - don’t blink first. Tell your ex you are going to fight her on this and if it cost you both $100k - so be it. My ex ended up backing down - I was willing to risk the $100k to make sure my kids were not taken from me - she was not willing to risk $100k for a chance the Judge ruled in her favor and allowed her to move.
