2 years divorced, 3 years separated. Ex and I did the FLS client calculator to determine child support and maintenance amounts. We did NOT use a lawyer. Mistake, i know. From the time the numbers were run to the point where she got a new job, she saw about a 17% pay increase during that time. I chose NOT to go after a modification. A year later, after her performance review, she is now up about 28% from the original numbers. Definitely more than a 10% swing to ask for a modification. Also, that was before new tax laws that changed maintenance payments from tax deductible to nothing. Benefits my ex. I get it, tax laws change.

So here is my question. Am I safe to ask the courts to modify the maintenance and child support based upon the 28% increase in salary and include discussion regarding the tax changes? Should i just focus on the numbers for the child support modification or should i ask for a whole change to maintenance and child support based upon the new tax laws and her pay increase.

Also, i know she has had this raise since the first of the year, do i stand a chance of asking for back payment should the judge rule in my favor because she didn't tell me about the raise?
