Under North Carolina law, he would have to pay, but under Virginia law he doesn't. This case was about which state's law governed the situation, with people moving between states.

So this case is hardly a win.

Thanks to this sub for bringing this issue to my attention (I saw this while browsing Reddit more generally). I'll look into this, and if necessary, see to it to attempt to remedy this. Nobody should have to pay child support for simply donating sperm.

Ok...let’s get this straight, he got fucked over for ignoring the family court petition that he pay child support, where the court doesn’t know that he was a victim of rape. Had he not ignored it and gone in with a lawyer and potentially filed a counter suit he could have had that dismissed since he was a victim of a crime....assuming he had reported it (which he likely didn’t), but he could still make the point of being a victim of a crime. The same would happen and has happened if the roles were reversed in a way.

What then about the veteran who couldn’t pay child support as he was a PoW in Iraq at the time and was arrested regardless as soon as he stepped foot in the USA after being set free:

Either way, the case Hermesmann vs Seyer set a precedent that a woman can pursue the father of her child, regardless of circumstance (eg if she committed rape to become pregnant) so that in the future, any child who finds himself unfortunate enough to be in a similar situation will have no option but to pay child maintenance to his rapist:

Omfg. No it’s not his fault. But the court she filed with doesn’t know he was raped because it wasn’t reported. Even if he did report that would have been criminal. Again, family court wouldn’t know. You make the assumption that the whole court system know all this crap. They don’t. He could have made his case and it would have been dismissed. Same goes for the POW. The system maybe be biased against men, but this isn’t a case of that. If he had presented his case timely he wouldn’t have gotten the default judgment. It’ll be harder to fight now. Fml.

Should be, but won’t matter until seen by a judge....the point being is that he has to make his case and he ignored it. Judges always in favor of the petitioner when the other party doesn’t show up. He needs to take her to civil court and see if he can still file a rape case.

The ruling explicitly mentions a woman can claim child support from a man “even if conception occurred as a result of a criminal act committed by the woman”.

i.e. the court was aware of the ages at the time of conception, and still decided he should pay.

I can’t remember details, but think this is possible because of a federal amendment to child support laws which removed ANY possible defence to non-payment of child support.

It was that amendment which made it possible for the PoW veteran (linked in my prior comment) to be arrested and jailed for non-payment upon his release and subsequent return to the US.

So unfortunately I don’t think there is anything anyone in a similar situation can do legally to avoid their cild support “responsibilities”.

What if he doesn't have any means to fight in court battle ,and didn't the court also said it doesn't matter if he was raped or not . He might be able to get woman in prison for couple of years as woman get way less and lenient sentences and moreover she is also a single mom now ,but it would not be possible to get out of paying child support.

I’m not a legal expert so I can’t say anything. All I know is if you get mail from the court, You never ignore it. The least he could have done is consult with a lawyer and seek legal aid society’s. He’s either gonna pay a lawyer or child support. And he could very well appeal this decision considering the mitigating circumstances. His rape. Alternatively he could find a legislator to create legislations that underage male victims of hetero rape not be responsible for child support of a resulting pregnancy. He has to go through legal channels or leave the country or state and only ever get paid in cash and never pay taxes. That’d be one way to doge it. Go off the grid.

What I’m trying to achieve is a dose of a reality and what could possibly be done to rectify this particular situation or future ones that are similar to this in a common sense way using the system. A lot of people responding are like well they should automatically know, blah blah blah. They don’t. Not really. And the judge as a family judge may not consider other things. And as I just learned this has to do with some federal law and obviously very narrow interpretation. But he should be able to try to appeal because a different judge may consider the circumstances differently, and make lawmakers aware of his situation.

Isn’t that the possibility every time someone has sex? The only way to fix that is to literally set up some kind of legally binding contract before each consensual sexual encounter. And it’s great that you’re for abortion, however that option is being whittled away in every state at every turn. Unfortunately because women carry the children the burden is on them, hence why the system is tilted the way it is. Is it right, perhaps not. Does everyone involved have a responsibility in the caring for the child (one way or another, yes). The ideal would be everyone has a sense of responsibility in protecting themselves from having children as a result of a casual encounter. And if a pregnancy results and after a discussion and one person or the other doesn’t want the child; in this case the male, but the female does...then she should be solely responsible. However in the end we all pay regardless, because if she isn’t self sufficient that kid ends up in foster care or using WIC etc. and you do realize that child support system is supposed to incentivize fathers to be in their kids lives (now that’s a whole separate issue from courts not granted 50-50 custody for bullshit reasons and is another can of worms entirely. For every story of a man supposedly saddled with child support for a kid he didn’t want, there’s stories of a legit dead beat, POS father who did in fact neglect his child when he had custody and never paid child support. I have heard stories from both fathers and mothers dealing with a shit DNA donor of either sex. TLDR; people (male female) can be shitty and the system hasn’t caught up yet.

Or at the very least, be very careful who you sleep with, know their intentions, wear condoms, make sure they're on birth control, etc.

That is a lot simpler than having a potentially irreversible procedure done.

Obviously, if you 100% know you don't want kids, yeah, get it done. But if you're iffy? Don't.

I'm pretty sure I don't ever want kids. But I might meet the right girl and want to start a family, so I'm not going for the nuclear option just yet. Instead we have an adult discussion early on when sex is on the table, and I lay out my concerns.

If she isn't on birth control, I want her to go on it. If she refuses, that's 100% her choice. But it's also my choice to walk away if that's what she chooses, because I'm not going to be roped in, accidentally or not, to a child I do not currently want with a woman I have not decided to spend the rest of my life with.
