The law should also include media - any agency that published the false rape claim must be required to be publish the exoneration in the same manner, same page, same spread, same news time slot, same length of feature explaining the exoneration, equal in all aspects. This would hold journalists accountable and support the innocent.

Depending on the jurisdiction and how far you get into the process the typical criminal charges you can see from a false rape allegation would be false reporting and perjury. Both of those charges do carry a minimum prison time, though whether or not the person will be eligible for parole is again dependent upon the jurisdiction.

Early in May of this year the US state of Alabama began reviewing a bill that will further criminalize false rape allegations, making them a class c felony with a minimum 10-year prison sentence.

In addition to criminal charges a person caught making false rape allegations will typically end up in a problematic financial situation due to the fact that the victim of the false allegations will typically have a strong case suing for slander, libel, and/or personal defamation.

This is great. You're right, everyone is so on-guard against false claims, it hurts the credibility of legitimate claims, and there isn't currently a whole lot of disincentive against such false claims. The words "rape" and "assault" are thrown around so flippantly today that they're used even in non-rape, non-assault situations. This broadening of definition is not good at all, as it makes people feel more justified in accusing someone of rape or assault, when in reality it may have just been an instance of misunderstanding, accident, or disagreement/argument. As a college student, I'm very hesitant to try to date or anything, because pretty much every girl on a college campus has the power to have pretty much any guy expelled if she wants. All it takes is the mere accusation of sexual misconduct. It's disgusting that there are people who will exploit the severity with which the sexual assault of actual victims is treated just as a means of revenge or leverage for manipulation. I agree 100%, wholeheartedly, something needs to be done. Sexual assault is a big deal, and it's no joke, and neither are false accusations of it either. The crime of a false rape/assault report needs to be treated just as severely as we treat verifiable rape/assault cases.

The problems are wide and varied with this - although I wish that it didn't become this complex and action could be taken against the false accusers.

1) Prove someone is lying. The courts don't do this. The jury doesn't do this. The police don't do this. The very nature in which this is viewed is that there is enough evidence to say you are guilty, or there isn't. If there isn't, you're not found innocent, you're found not guilty. There is a big difference between the two.

2) You have to prove somebodies state of mind that this is actually malicious. Talk to any lawyer and you'll see how hard this is to pull off.

3) We already have charges in the majority of the world for filing false reports etc - but these are very rarely used. The best chance of 'success' here would be to encourage these charges to be used more in obvious cases.

4) The police and witnesses screw up. Sometimes cases fall apart only because there was a mistake in police procedure - or witnesses disagree on events - sometimes even different stories between witnesses. You need to ensure that this doesn't fall into the same category - otherwise you end up punishing someone for somebody else screwing up.

It's a great ideal for the outcome, but the way the law is written in many countries, its too hard to make this happen without a drastic rethink in how we enforce laws. Given the current climate, I don't think anyone would have the political fortitude to even attempt it.

False accusations hurt both men and women, and I know that more often then not the claims will be legitimate, and there needs to be a system in place that if a victim has been found "guilty" of a false accusation, meaning the rape charges are found to have insufficient evidence, without intent, they need to be kept protected. Rape is fucking terrible. I was raped when i was a preteen by one of my moms girlfriends 30yrs my senior. I was big for my age, but i was still just a little boy in my head. I had mixed feelings about it while it was happening and even shortly after.

I can say firsthand that it's something that will follow you forever. Im infatuated with sex. Im well into my 30's and my libido hasn't changed since i was a teen. The constant arousal is not healthy and i know this.

I can't be intimate, it's always fucking. I have horrible fantasies, many of which make me fucking sick to think of. For the longest time i wanted that bitch dead and at the same time wanted to fuck her again. The duality is often times overwhelming, and I've had severe depression in my life from it.

I remember telling my mom about it and she thought i was full of shit. I even told her about a tattoo her friend had just above and to the right of her vagina. Mom had some bullshit excuse for how I could've seen it. I remember drawing pictures of pussies all the time after that.

Having said all this, if someone is such a lowlife piece of shit that they think false rape cases make good revenge, i say throw the fucking book at them. There are REAL rape victims out here that don't think is fucking funny.

Women who admit to, or are proved to have lied about a rape should, imo, suffer the same sentence as a rapist.

If say, Steve is accused of rape, his local papers can report that he is suspected, slander his name, make it impossible for him to get a job, then he's found innocent, but that damage is done.

Same goes for any crime, if you lie about it to frame someone or set someone up, or accuse them of shit they didn't do, you should then face the same sentence that said crime carries

I see this change as both good and bad. Think about how many men have been exonerated from their crimes of “rape” years later after the woman has decided to come clean and admit she lied.

With this law in effect you can guarantee that that would happen 0% of the time because the women would fear getting a similar sentence to the men.

So while it sounds good in theory I don’t think you can properly instate this law without first changing the mentality of rape accusations (aka man is always wrong).

While this could end up holding more women accountable if the charges are proven false quickly(before the man serves jail time). Without first changing the process for convictions you would just end up hurting more men than helping them.
