I don't understand, she never saw the "guy" in person without a blindfold on?

[–]Ravenae 38 points39 points40 points 9 years ago (1 child) | Copy Link

This was posted earlier this week and one of the comments said they did a bunch of activities together, including watching TV, while the victim was blindfolded the entire time.

[–]powershirt 41 points42 points43 points 9 years ago (0 children) | Copy Link

What a dumbass. I'm talking about me, cause it's that easy and I never done it.

[–]Forcistus 62 points63 points64 points 9 years ago (15 children) | Copy Link

Basically stupid meets psycho. I don't understand how this is a real case, honestly. I'm not seeing the crime.

[–]powershirt 14 points15 points16 points 9 years ago (10 children) | Copy Link

I dunno, I feel the same way then I think if the roles were reversed would I be mad? And I would be. Would the guy who pretended to be a girl get in trouble? I dunno.

[–]Forcistus 22 points23 points24 points 9 years ago (7 children) | Copy Link

Would I be mad? Oh, for sure. Would I expect them to go to jail? Nah.

Especially if I had never met the person without a blindfold for all that time.

[–]jkmonty94 46 points47 points48 points 9 years ago (6 children) | Copy Link

Right?

If you're letting a stranger you've never seen in person fuck you, on multiple occassions, while you're blind folded, you need to take some god damn responsibility for your actions at that point lol

[–]powershirt 11 points12 points13 points 9 years ago (5 children) | Copy Link

It's ridiculous

[–]Forcistus 10 points11 points12 points 9 years ago (4 children) | Copy Link

The equivalent would be of you constantly met a "woman" who you never had seen or communicated with aside from via text and you repeatedly had sex with her through a glory whole. Everyone would just assume you were living out a closeted gay fantasy because there's no way you actually believed that was a real woman.

[–]powershirt 7 points8 points9 points 9 years ago (0 children) | Copy Link

If she's mad cause she was fucked with a fake dick would she be able to press charges if it was a dude with a real dick instead but he used viagra to get a woody to do so? It's a fake hard on instead of a fake hard penis.

[–]BrownChicow 0 points1 point2 points 8 years ago (2 children) | Copy Link

It would be the equivalent if you thought you were meeting a woman, you blindfolded yourself and instead of fucking a girl it was a guy jerking you off with a fleshlight. I'd be like, whoa wtf, but to think that person belongs in jail is ridiculous, you fucked up

This is not pussy pass denied

[–]Forcistus 0 points1 point2 points 8 years ago (1 child) | Copy Link

We're saying the same thing here

[–]BrownChicow 1 point2 points3 points 8 years ago (0 children) | Copy Link

I know, except in yours the guy is actually having sex, or getting a blowjob or whatever, in mine it's a toy like in the girl's case. But yes

[–]MrMiller 2 points3 points4 points 8 years ago* (1 child) | Copy Link

If I'm hanging out blindfolded with a "girl" for a period of time doing activities and such, then somehow we get in bed and I'm slyly coaxed into thinking I'm in a vagina but it's actually an ass hole and I don't discover the dick, then really, that's all on me. I would feel stupid and embarrassed. I could be mad at "her" but mostly at myself. I think the same goes for this situation. That lady is a creep but that's all so stupid the case should just be thrown out.

[–]powershirt 0 points1 point2 points 8 years ago (0 children) | Copy Link

Lol my bad, I don't think anyone will confuse an asshole with a vagina, I was referring my to like an oral sex situation,

[–]Ragnrok 6 points7 points8 points 9 years ago (2 children) | Copy Link

The crime was inserting a toy into the woman's vagina without consent; she had consent to put a penis in, not a dildo. I imagine that if I had consensual sex with a woman and she found out in the morning that I was wearing a strap-on and she tried to get me charged with a crime she'd be laughed out of the police station, but what this woman did to her friend was so incredibly fucked up that they charged her for a bit of it that was technically illegal because a psycho like that absolutely belongs in prison and she did technically break the law.

[–]Frankifisu 6 points7 points8 points 8 years ago (0 children) | Copy Link

What if she were indeed a man, but had lied about his appearance using fake pictures? Would it be a crime?

[–][deleted] 1 point2 points3 points 8 years ago (0 children) | Copy Link

"Psycho"

Do you actually believe this happened?

[–]srtor 0 points1 point2 points 8 years ago (0 children) | Copy Link

No crime was committed. Was there any agreement that only a 'real penis' will be used?

Everything about women is fake. Fake boobs, fake butts, heavy makeup etc etc, why does it matter she(he?) used fake penis.

Fucking SJW judge. Western justice is a fucking joke.

[–]Lenovojunk 0 points1 point2 points 9 years ago (1 child) | Copy Link

Reminds me of this clip from mad tv https://youtu.be/bgcLfohtFbE

[–]powershirt 0 points1 point2 points 8 years ago (0 children) | Copy Link

Lol almost spooky

[–]Electricpants 186 points187 points188 points 9 years ago (8 children) | Copy Link

"...every once in a while, it's a dildo. Although it is company policy to never apply ownership in the event of a dildo. It's always, 'a dildo'. Never 'Your dildo'."

[–]goodygood23 39 points40 points41 points 9 years ago (3 children) | Copy Link

Pretty close from memory. I like the "indefinite article" detail though:

"But, every once in a while, it's a dildo. Of course, it's company policy never to imply ownership in the event of a dildo. We have to use the indefinite article, "a dildo", never ... your dildo."

[–]DontGetCrabs 3 points4 points5 points 9 years ago (1 child) | Copy Link

[–]snowclick1 points 9 years ago* [recovered] (5 children) | Copy Link

It's so funny seeing news sites try to make headlines as appropriate as possible. "Fake penis" come on, just say dildo. It's 2017 and you're an online news outlet.

[–]smokeydaBandito1 points 9 years ago [recovered] (4 children) | Copy Link

Is a dildo like a buttplug?

[–]MickeymousetitdirtTop score holder at meatspin.fr 4 points5 points6 points 9 years ago (3 children) | Copy Link

No...a dildo is exactly what the person above just said: a fake penis.

Is your comment a reference from somewhere that I missed or do you really not know what a dildo is?

[–]smokeydaBandito1 points 9 years ago [recovered] (2 children) | Copy Link

I was implying that I was so well acquainted with the concept of butt plugs that I didn't know what a dildo was.

[–][deleted] 1 point2 points3 points 8 years ago (1 child) | Copy Link

implying

Nope.

[–]Auto_Traitor 54 points55 points56 points 9 years ago (38 children) | Copy Link

So what's the charge? If the sex was consensual, then what the fuck?

[–]face_keyboard 50 points51 points52 points 9 years ago* (30 children) | Copy Link

Sounds like they were not able to consent because they didn't know exactly what they were consenting to. Either that or you can revoke consent after the fact. Either way it's bullshit

Edit: it is the former

[–]Auto_Traitor 42 points43 points44 points 9 years ago (17 children) | Copy Link

It's bullshit that this is the exact opposite of ppd. Men encounter traps much more frequently, some even fall for it, and I've never once heard of charges filed on the tranny.

[–]Forcistus 21 points22 points23 points 9 years ago (0 children) | Copy Link

Men probably don't report it.

[+]Expandedcelt1 points 9 years ago [recovered] (7 children) | Copy Link

Yeah it's just a viable legal defense in many states to defend murdering a trans individual as "trans panic" They have it so much better not having to deal with the getting charges pressed though

[–][deleted] 24 points25 points26 points 9 years ago (0 children) | Copy Link

Nobody has ever used that and gotten away with murder.

[–]Auto_Traitor 7 points8 points9 points 9 years ago* (5 children) | Copy Link

To be fair, that defense doesn't get anyone off the hook for murder, only provides a relevant (imo) explanation as to why violence occurred. Panic implies they weren't thinking clearly, in normal life one may say trans/gays are equal (I agree) but in discovering a trap, panic takes over. Doesn't excuse it but does explain it.

Edit: If you disagree, discuss it, nothing I've said is unreasonable.

[+]daoogilymoogily -10 points-9 points-8 points 9 years ago (4 children) | Copy Link

It definitely has and definitely would again, there's a bunch of instances of gay panic (it was literally on the books in Texas) getting people off the hook for murder and to a conservative judge someone hiding their sex would be a much greater cause for the crime. Hell a guy in Texas tried to use this defense after murdering a trans girl he'd been dating for like five months. But besides all this people talk about 'traps' like dudes that can pull off looking like hot/decent chicks are just flooding the streets preying on innocent 4chan users, but the only time I've ever seen this was at a gay guys Halloween party (coulda just been dressing up for the holiday lmao). Regardless people shouldn't be hiding their sex from others and should be open about their sexuality and people don't have an excuse for murdering someone besides self defense.

[–]Auto_Traitor 7 points8 points9 points 9 years ago (3 children) | Copy Link

Can I get links for someone getting off with zero repercussion using this defense? It shouldn't be hard if there's a bunch of them. I looked but couldn't find anything (recent or otherwise). However, if it has, I doubt that it "definitely would again" considering it's banned in many places and in the process of being banned in many others.

But like I said, it's not an excuse, it's an explanation as to why some humans act as they do. Also, I never implied that hot trannies flood the streets, I stated that a male will be more likely to encounter that situation than a female will encounter one like in the OP.

[–]daoogilymoogily -2 points-1 points0 points 9 years ago (2 children) | Copy Link

Wasn't trying to say you were saying that, but it seemed like there was another person in this chain saying that and that it's a common sentiment in this thread. But the legal defense of gay panic is only banned in California and while it hasn't been wildly successful in getting people off it has and it's also lessened a lot of sentences.

[–]Auto_Traitor 2 points3 points4 points 9 years ago (0 children) | Copy Link

It lessens sentences because with the way some people feel about these issues, it is a legitimate mitigating factor. Being tricked into sex by someone who either repulses you, or has now "damned you to hell", is understandably likely to get backlash. Not ok, but understandable.

[–]blackxxwolf3 1 point2 points3 points 8 years ago (0 children) | Copy Link

please provide links to your claims of it has happened and has worked and will again. otherwise fuck off. "california has banned it" you shouldnt be banning a legal defense. thats retarded. it just doesnt work.

[+]Stun4191 points 9 years ago [recovered] (7 children) | Copy Link

Hey dude, tranny = offensive. Trans is the correct and polite term. Found out recently & I guess it makes sense. Anyhoo, cheers!

[–]Ragnrok 7 points8 points9 points 9 years ago (0 children) | Copy Link

"Tranny" tends to refer to an individual who presents as a female until her pants are off and you see a big ol' swinging dick pop out. The closest there is to a non-offensive term is "pre-op trans woman" but, in addition to being a mouthful, a lot of these individuals like their penis and aren't "pre-op" because they have no intention of losing the dick. Any other word or phrase to describe this kind of individual (shemale, ladyboy, chicks with dicks, trap) are as or more offensive than "tranny".

And this is anecdotal but I once had a trap message me on a dating site saying "Do you like fucking trannies", so at least one of them is okay with that word.

[–]Auto_Traitor 3 points4 points5 points 9 years ago (1 child) | Copy Link

Haha, I likely won't care, but thanks. Eventually trans and even transvestite will be too, but what can ya do?

[–]PsychedelicDentist 1 point2 points3 points 9 years ago (3 children) | Copy Link

I'm not saying it is or isn't, I would just like to know what "makes sense"? Why is this this common phase now offensive in your opinion?

[–]Stun4191 points 9 years ago [recovered] (2 children) | Copy Link

Most of the time I hear the word tranny it's someone insulting a trans person, so from my POV it's used as a derogatory insult/slur. + Trans is obviously short for transgender so it seems like the correct way to shorten the word. That's how it "makes sense" from my perspective! And tranny also hasn't been a "common phrase" here in Montreal so you could have had many different experiences hearing these words than I have.

[–]PsychedelicDentist 2 points3 points4 points 9 years ago (0 children) | Copy Link

I feel like this is too sensitive a response. It's comes across like victim behaviour. Like being offended for the sake of being offended. The word "tranny" seemed to come about as the shortened version of 'transgender', it may roll of the tongue easier than the word trans for some people; and to assume trans is the 'correct' way of shortening a word is so truely subjective, it would be ridiculous to take offence to someone using tranny as an alternative.

The transgender community I have come across didn't gave a shit about the term tranny, so to assume its offensive to the entire community based on a small cohort, will be too big a stretch to make

[–]ITomza 1 point2 points3 points 9 years ago (0 children) | Copy Link

Isn't 'tranny' also short for 'transgender'?

[–]101Mage 2 points3 points4 points 8 years ago (1 child) | Copy Link

Sounds like they were not able to consent because they didn't know exactly what they were consenting to.

Eh, this seems about right to me...

[–]face_keyboard 1 point2 points3 points 8 years ago (0 children) | Copy Link

That's what the courts determined

[–]EtherMan 0 points1 point2 points 8 years ago (0 children) | Copy Link

Not knowing what you're consenting to, is not legally consent.

[–]Macmang29 0 points1 point2 points 9 years ago (8 children) | Copy Link

Fraud

[–]face_keyboard 2 points3 points4 points 9 years ago (7 children) | Copy Link

It was actually sexual assault

[–]Baloney--Sandwich1 points 9 years ago [recovered] (6 children) | Copy Link

No. It was consensual. She just changed her mind later. She came back for more over and over and over. She just changed her mind later. Cunt.

[–]face_keyboard 1 point2 points3 points 8 years ago (5 children) | Copy Link

Not exactly. She consented to having sex with a man, not a woman.

[–]Baloney--Sandwich1 points 8 years ago [recovered] (4 children) | Copy Link

Doesn't work like that, she was blindfolded and consented to have sex with that person over and over for a long ass time, years. She changed her mind when she found out. Ant woman can tell the difference between a mans cock and a piece of plastic. She gave consent but then changed her mind. Cunt and anyone who thinks otherwise is just as dumb a cunt.

[–]face_keyboard -1 points0 points1 point 8 years ago (3 children) | Copy Link

Cunt and anyone who thinks otherwise is just as dumb a cunt.

Very insightful

[–]101Mage 4 points5 points6 points 8 years ago (0 children) | Copy Link

What's insightful here is your lack of a counter argument.

[–]Baloney--Sandwich1 points 8 years ago [recovered] (1 child) | Copy Link

I guess we know what that makes you.

[–]face_keyboard -2 points-1 points0 points 8 years ago (0 children) | Copy Link

Can't argue with that sound logic

[–]KantaiWarrior 2 points3 points4 points 9 years ago (6 children) | Copy Link

Yeah, I'm still having trouble understanding what law was broken here.

To me, whatever law they got her on was twisted I bet, surely it doesn't cover anything like this.

[–]PM_ME_UR_SMILE_GURL 5 points6 points7 points 9 years ago (4 children) | Copy Link

Many crimes can be committed "by trick" of "under false pretenses." It is based on the fact that, if it were not by the intentional misleading by the perpetrator, the victim would not have done what they would have.

For example, if you were a jeweler and someone came with a golden ring and asked you to apprise it and you told them it isn't worth much, knowing full well that it is work quite a lot, then you buy the ring at that lower price, you'd have committed the crime of "false pretense" because you only got the ring at that low price because you misrepresented the value.

If you had sex with someone who is under the assumption that you are a man, but you are in fact a woman pretending to be a man, you would be committing sexual assault because you only got into bed with that person because you misrepresented yourself.

[–]Look__a_distraction 2 points3 points4 points 8 years ago (1 child) | Copy Link

How does that law apply to transsexuals? I'd you're not biologically female and don't disclose is that also a crime?

[–]blackxxwolf3 1 point2 points3 points 8 years ago (0 children) | Copy Link

according to this women being jailed yes it actually is.

[–]jbaughb 2 points3 points4 points 8 years ago (0 children) | Copy Link

Whats scary is taking this same logic to other conclusions. If I represent myself as rich and a girl sleeps with me but finds out later that I was lying, can she remove consent after the fact?

[–]nikosteamer 0 points1 point2 points 8 years ago (0 children) | Copy Link

What they have sex with me under the pretense Im a nice guy ?

[–]Auto_Traitor 0 points1 point2 points 9 years ago (0 children) | Copy Link

It's the exact opposite of ppd and doesn't belong here.

[–]Auto_Traitor 41 points42 points43 points 9 years ago (3 children) | Copy Link

This doesn't belong here, it's the opposite of ppd, this girl shouldn't even be getting charges. The end of this sub is near. No wonder people think we're a bunch of woman haters, just because a girl gets in trouble doesn't mean it should be here.

[–][deleted] 13 points14 points15 points 9 years ago (0 children) | Copy Link

Agreed that it’s the opposite of PPD. It’s more like DPD, dildo pass denied.

[–]infuriatesloth 1 point2 points3 points 9 years ago (1 child) | Copy Link

I just noticed what sub this was and wondered what the hell you were talking about

[–]originalmimlet 0 points1 point2 points 9 years ago (0 children) | Copy Link

Same. I read post "partum depression" for a coupla posts until I realized where I was.

[–]pussycatmando 2 points3 points4 points 9 years ago (0 children) | Copy Link

Lonely and dumb are lethal mixes

[–]infamousnexus1 points 9 years ago* [recovered] (2 children) | Copy Link

But what if she identifies as male?

[–][deleted] 19 points20 points21 points 9 years ago (1 child) | Copy Link

Her sentence would’ve been doubled.

[–][deleted] 1 point2 points3 points 9 years ago (0 children) | Copy Link

If it was actual sexual assault, maybe, but it wasn't. I don't get how this is a crime. It's a shitty, dishonest thing to do, for sure, but this was consensual. How about you actually look at the person you're having sex with for fuck sake. It's almost like having sex with an ugly person when you thought they were hot and you go back on saying it was consenual after finally looking at them. The fuck is wrong with the justice system.

[–]Moshart 2 points3 points4 points 8 years ago* (1 child) | Copy Link

If this doesn't show you that the system is fucked, idk what will. You can't watch tv if you have a blindfold on. You can't do a lot of shit if you have a blindfold on if you aren't use to being blindfolded.

I don't know what happened, but I do not believe what evidence has been accepted by the courts. It doesn't make sense. There is still reasonable doubt.

[–][deleted] 2 points3 points4 points 8 years ago (0 children) | Copy Link

If someone wanted to have a relationship with me, but only wearing a blindfold...I would presume it to be Quasimodo!

[–]srobinson2012 1 point2 points3 points 9 years ago (0 children) | Copy Link

[–]MrPartyWaffle 1 point2 points3 points 9 years ago (0 children) | Copy Link

How would she get into the role though?..to really smell like a man?,some beers with the boys, a lil vindaloo after?...slip on a prosthetic penis at the end of night....that's ma girl!!!

[–]burrbit8b 2 points3 points4 points 9 years ago (5 children) | Copy Link

Yeah this doesnt make any sense, she consented to the sex.

[–]Gawernator 6 points7 points8 points 9 years ago (4 children) | Copy Link

Sounds like she consented to sex with a man but was deceived

[–]burrbit8b 8 points9 points10 points 9 years ago (3 children) | Copy Link

That part I understand, I just don't understand how its sexual assault. Granted it was under a false pretense, but you cant withdraw consent after the fact. If I lie to some girl, implying I am some wealthy individual can she withdraw consent after she finds out I am actually some broke jobless fuck? If anything, this is the biggest pussy pass card being played from the supposed "victim"

[–]Gawernator 1 point2 points3 points 9 years ago (1 child) | Copy Link

I don't think that's the same. She consented to being penetrated by a human penis, not a dildo. Weird but still

[–]blackxxwolf3 1 point2 points3 points 8 years ago (0 children) | Copy Link

boy transgender people are gonna have one hell of a time. now they are going to have to shout IM TRANS every date they go on.

[–]Azerov 1 point2 points3 points 9 years ago (0 children) | Copy Link

Then, you my friend committed "rape" because women can retract consent at any point, even years down the line.
