So a man has no right to say he doesn't want to be a parent, but the woman does.

And although this heading says only if the man is a rapist, in fact the law already exists if the father is a rapist -- this law is for when he is not a convicted rapist but the mother says he is a rapist anyway.

Note - this bill allows for paternity to be revoked using the civil burden of proof (preponderance of evidence) rather than criminal (reasonable doubt.)

While rapists should have absolutely no paternal rights to children conceived through rape, under this bill any woman could potentially have a father's rights revoked by accusing him of rape in civil court, where the burden of proof will be on the father to prove he didn't rape anyone, rather than on the prosecutor to prove he did.

Civil court has no business deciding criminal questions. They can base a ruling on a criminal court's ruling or any fact finding publicized by a jury (usually as part of sentencing guidance), but should go no further.

The bill sent to Snyder by the Senate on Tuesday allows a mother who proves by “clear and convincing” evidence that her child was conceived as a result of rape to have the perpetrator’s paternity revoked.

What kind of "clear and convincing" evidence is this? I can see the courtrooms now...

  2. It applies to women removing paternity from men, but not men removing themselves from paternity if raped.

It would be interesting to see whether the bill applies in cases of statutory rape, as well. If so, that could potentially help some of the underage boys who have been required to pay child support after being taken advantage of by adult women. If parental rights can also be terminated in cases of statutory rape, that should at least allow some of these boys to pursue an equal protection challenge if they are denied the same protection from the law.
