Thank you for participating in our sub! I have read your comments, and I am pleased by some of your statements, but I do not find your conclusions compelling based on other accounts.

For California, they include:

In California, a man reports his male friend is scratched and hit by a woman in multiple attacks, but he is denied services

Good guy cops saved a buddy of mine from getting arrested by.. Not arresting his girlfriend for threatening him with a hammer

It's funny because you mention that you're in a liberal jurisdiction.

In Michigan, this (disclaimer: my) Analysis of Friend of the Court Custody Recommendations showed a strong racial bias, with no more than 3/5s of African American fathers getting sole or joint custody when compared to White Non-Hispanic fathers.

What I didn't calculate, but could have, is the impact of politics on child custody outcomes, because percent of father sole or joint custody in a county is strongly and positively related to how conservative each county is.

I feel the results also demonstrate that child custody outcomes are driven primarily by race and political climate, or perhaps the associated demographics (e.g. whether the parents are getting divorced or were never married), and not by the individual merits of each case.

I can't speak to California, because I don't have any data (anyone have a breakdown per jurisdiction there?), but for Michigan, I would say the courts in some jurisdictions may be biased against men, or others against women, given the wide variations in large numbers of child custody cases from county to county.

The entire legal system is biased against men, not just in family law, though that may be one of the most visible. Your argument that anger at this bias is misdirected and should be pointed at the social status quo is irrelevant. When the agents of the law enforcement and legal systems in our society harbor these biases, they will inevitably go along with them in the discharge of their duties. That makes the issue a legal/judicial issue as well as a social one. When a judge orders a man be jailed for contempt for violating an order he could not possibly have complied with, he is acting out society's bias against men. That doesn't mean his biased actions are not a perfect example of the bias in the court system.

Not only that, but the court system is often biased not only against men, but against the law itself. It is unconstitutional to jail someone who cannot pay child support for contempt. And yet it still happens every day. That's not even mentioning the dramatic bias against men in criminal sentencing, either. Or the biased, broken DV model used in our country.

The very notion of lifetime alimony or imputed income shows a glaring disconnect with reality and principles of fairness, and another tool to use against men.

Add to this the ease of obtaining protective orders, even temporary ones, as well as the prevalence of 'tactical' accusations of abuse/violence. Then consider the dramatic bias in awarding custody. As I'm sure you're aware, best interest of the child is often read to the effect of minimizing the disruption of their life. So, with the ease of evicting a man from his home, even for 2-3 weeks, gives the spouse a home-field advantage already. Add to this that men are often made to pay their spouses' costs, reducing the funds they have to pay for their own attorney.

While technically, the above could by the strict letter of the law apply to women as well (and there are cases where women are ordered to pay support/alimony/ect.) the overwhelming majority of these legal tools are used against men, because they are men. This is de facto, if not de jure, bias/discrimination. It is proof positive that our legal system is biased against men.

Edited to add: Another great example of bias is the court system's willingness to entertain contempt charges with regard to support (often handing down illegal punishments, as noted above) owed by men, contrasted with the deafening silence when custody/visitation orders are violated by women.
