If you're unable to pay child support, the judge may consider siding with the custodial parent.
So let's say you are below the line of poverty. No fault of you alone. You don't have to pay child support but you have equity. That's not a position you want to find yourself in. As long as you can pay child support, you can take half the equity and half the kids. It's the way this system works sometimes for better or worse

the lawyer is lying (fun fact lawyers lie if it furthers their clients case, some would even say it's an occupational requirement)

If wifey has money or makes money to get the house out of foreclosure then I see no reason you need to sign anything.

and it does not matter if this is a gender flip and you are woman asking as a man... curiously in a divorce_men forum...

whoever has money in the marriage will likely fund the home to keep it afloat while divorce is ongoing.

you both will need to sign on any sale of the home, you both have an interest in the home being current in the mortgage to preserve the equity interest in the house

if you don't have much concern about your credit impact due to mortgage foreclosure... let it be the spouse that makes the most own thing to worry about.

Status conference hearing tomorrow: have a court date tomorrow. Not really sure what to expect. This is the second status conference hearing. Since the first one, ex has held kids from me. We have a written/signed interim agreement. Judge told us to follow it. She broke that many times since last meeting. With the holidays next week, I want to know exactly when I’ll see my kids. I’ve had my kids 3 nights in the last two months. It’s killing me. I am supposed to have them every Monday Wednesday and one weekend day for now. I am going for 50/50. The first conference hearing it was just us two and the judge. This time it’ll be me, her, and her attorney and the judge. I am sure her attorney will do everything to rip my time with the kids away from me. I’m a good, present father. I have never missed anything with my kids. I support and participate everything they do. My ex is not a bad mother. I don’t want to point out flaws in her parenting at all, but I’m afraid I may have to in order to make sure I get my kids 50% of the time. I plan to just highlight my parenting and what I do for the kids, and hopefully not even talk about her parenting. However, the second they start claiming anything that makes me out to be a bad parent, I will not be able to hold back. Any advice would be appreciated.. this has been the toughest two months of my life.

She would need to buy you out of the equity on the house. Your financial mistakes are also hers in the marriage as debt is split between two people in most divorces. Get a lawyer and dont roll over. Call the bank and delay things as much as possible regarding the foreclosure.

I should clarify.. the home is now in a plan to save from foreclosure.

If it's in foreclosure, do you collectively even have funds to save it anyway? Lawyer can't make money appear.

As far as getting to 50/50 custody, that depends almost entirely what state you are in and hopefully it's one of the ones that says 50% on this map: https://www.custodyxchange.com/topics/research/dads-custody-time-by-state.php

If the home is in foreclosure you probably don't get to determine what happens with it.

Children, alimony, and the primary residence are the biggest reasons you need a lawyer for divorce. You have 2/3 of those reasons.
