I separated in June from an abusive adulterous soon to be ex-wife. She started throwing books and hitting me after confronting her about her cheating. Calling the cops acting like I was the aggressor. Long story short, since she didn’t have marks and I did… she got arrested and magistrate awarded me the house. I have enough evidence to prove one of the cheating(recording of admission and tracked the location of her car(I’m the primary owner)) and know the person to subpoena for the other. I have another video where she was berating me and I locked myself in a bedroom to attempt to get some peace and quiet from her. She then started beating the door open with a golf club, saw I was recording, and then scratched up my leg bringing blood to get the phone.

She is narcissistic and borderline personality disorder. I tried taking the path of least resistance and doing a fair separation agreement, half of savings, her possessions, her car, etc. I made significantly more than her and the house (solely in my name with down payment with premarital money), my car, other half of savings, my possessions, etc.

She verbally agreed to all of the above. I had it drafted and everything changed. She got a free legal aid attorney. She is trying to negotiate part of the house, even though my lawyer said the law favors me for her to get nothing. And more is less being greedy and trying to take more than her fair share compared to her contributions.

Should I go for at fault to get this over with? I’m sure she’ll lie her ass off in court. I’d rather spend the money with at fault than giving it to her or lawyers fees for an uncontested litigation. As a side note, the sheriff placed an assault charge for the June incident on her, I placed one for the golf club at the same time. She placed a baseless one on me from the June incident to get me to drop them. All three were Nol Pros. Could I still charge her for the June one since it was the sheriff and not myself?
