Yeah, a lawyer. Not to sound snippy but you only get one chance to divorce and it should be in your best interest to do this right.

I would only divorce as a last option.

A lot of people jump into divorce for bad reasons, the worst being that you didn't try hard enough to make it work.

Plenty of people get into divorce and then 6 months later think "I can't believe I gave a shit about that problem"

Would like to know the specifics of your issues but if you don't want to provide, I suggest you take some time to think. Then try like hell to make it work. Marriage counseling if you haven't already.

As far as advice if you go through with it:

Be the one to file. It helps cut the chances of false domestic violence charges

Once you do file, take your time to go through the process. I mean like literally wait a couple months. Emotions are going to run high and those are no conditions to negotiate the terms of the next 10-20 years of your life.

After waiting it out a bit, find an example of a divorce settlement with kids for your state. Sit down with your STBX and rewrite the whole thing to your situation. Then try to fo a collaborative divorce by having a lawyer rewrite it in legally enforceable language

You can try looking at some of my previous posts, unfortunately most of this community will advise you to get screwed and advise you to recover and your lawyer will likely screw you and tell you got a great deal under the 'law'

If you're certain divorce is eminent then consider an uncontested divorce. (I did this and it was cheap)

But ofc if you all can't agree on division of assets and such then you'll need to lawyer up.

Does the wife work? How many kids?

Move to Alabama. I would not want to go through divorce in California.
