Default divorce

Mine was default because she refused to be officially served. She knew what was going on but I didn’t have an address for her to actually be served at so I ended up having to go before the judge several times explaining why until he was finally satisfied that I had actually tried (although he honestly sounded like it was the first time I told him the story every time I told him) and then approved me for service by publication and it was done within two months and two court dates from that. Basically everything in the proposed judgment was signed the way I filled it in and that was that.

Don't view a default judgment as final. Just view it as an extra step in the process. Not much for you to do except attend the default hearing so you can testify as to the facts in your petition or whatever else your lawyer says and the judge wants to consider. Then once she gets hit with something, she'll wake up, hire a lawyer and the judgment will be undone and back to square one, or basically square one.

If someone is properly served and they fail to answer or appear their default can be entered and the proceedings will continue to judgment based on what the petition says and wants.

If you are the defaulter it is risky for you to assume everything will be OK. once a judgment is entered it is very hard and expensive to set aside.

The other side never operates on what is best for you.

If you missed the answer due date and there is no final judgment you should have an attorney appear for you and at the very least file a court caption document call a notice of appearance with all your contact info, address, phone, email etc.

I’m on the same boat, sort of, she filed but everything she put i agree. Agreement is 50/50 on sale of house after debts get paid off by sale of house. I live in California. Lady at court house said not to worry if i do turn in my paperwork if i agree. Only thing pending is C/S and spousal which lady said comes later
