If you move out and leave her with the bills and child in her care it will look very bad to a judge and difficult to get 50/50. She will need income to cover costs cause you left and an emergency count will be held, The most likely outcome is the judge will look out for the child and will order you to cover it all. Get an attorney for advice before you do anything and get strong control of your emotions you have for the sake of the child.

I moved out after the stbxw gave me shit because she found a receipt for an attorney consultation even though we had been talking divorce for years. She said don’t come back and I didn’t. Finally got most of my stuff this past week. I filed in August, she was served almost 2 weeks ago.

My advice would be to leave ONLY if you feel the situation is going to get or already is really toxic. Fighting in front of your kid, sleeping in separate beds, etc. I stayed in my house (mortgage is in my name, title is in both of names) after being physically separated for over a year because I wanted to stack some bread and get on my feet once the divorce process started. It wasn’t easy though. Soul crushing actually in some ways.

I would expect her to get you to pay her child support. It doesn’t matter how much money she makes man. If she is primary you pay child support. You should be requiring alimony and assets split - depending on how long you have been married. Just hold your cards- don’t tell her what you want. If she wants child support rain you say oh okay alimony is on the table then. Most states child support is required and no one around it.

Do Not Move Out. By doing this you will indicate to court that you are okay with child being with mother. Your STBX will also get everything she wants (CS, SS, child, home, and no you) and will not have any motivation to finalize divorce in a foreseeable future.

You are going to have problems with the under the table finance. You will be order to pay child support from your income. Make sure you also show proof of whatever else you are paying for the children. The judge will take this into consideration. Make sure you tell the judge you want your child support to go through the courts. That way she doesn't get a wild hair and say you never payed her that month.

Which state are you in? What would you do in the case of a restraining order, DV charge or finding out infidelity? Lots of factors.
