There's exactly one state where a child's choice is presumptive, but that's not until the age of 14. So, no, the judge isn't going to make a decision solely based on their desire.

You need to be able to make the primary parent argument without them being involved. Your kids are never going to testify. At best, they *might* have an in-chambers discussion with the judge. But that's only after a GAL and/or custody evaluator has provided a report.

As far as I know children do get some sort of say at roughly age 12, depends on the state. They may not get to choose but they can provide input and it will be considered by the courts. Ask your attorney.

Similar situation. 6yo. As men, we're working from a defecit. I'm more than triple the parent she is. She would be classified as passive, permissive. I do everything for my daughter, including providing everything she wants while having high demands and being fair.

Unfortunately, the courts and agencies don't have the resources to look into your situation that closely. To have any merit, you need to document, document, and document. Record every time you have them, and any significance that your ex cannot provide for them.

More appealing is to go down the diplomat's route. Try to sell to her how easier it will be for her to have time off from the kids. How you can make it easy for your ex. How the kids are doing so great, but make her feel responsible for that somehow.

I'm legally 50/50 with my ex, but I'm getting close to full time by squeezing these conveniences as much as I can. It's a way for everyone to slowly get what's best for everyone.

This shit pisses me off. Spend some time around this sub and other online father’s rights pages and you’ll see how fucking hard dads fight just to get 50/50. Against this VERY SAME SHIT! You think because your kids tell you that they like being with you more, that you can deprive them of time with their mother? Legally take full custody? And that it’s in their best interest? GTFO with that bullshit. You’re what so many of us are fighting against.

Flip the script if you still don’t get it.
