50/50 Custody and Child support

In Ohio here. Child support here, and in most states, is a worksheet that auto calculates the amount of child support to be paid. If there is an income disparity between the two parties, even if 50/50 physical custody, child support will be paid. The recipient of child support can spend it on whatever they damn well please.

It's complete bullshit. In other countries (UK), I'm told that if there is 50/50 physical custody, no support is awarded. This country sometimes really really sucks.

Just because you have 50/50 custody does not mean you will not have child support. Child support is based on the difference in income & the timeshare. If your timeshare was less previously then I'm sure it'll go down but unless your incomes are similar it probably won't go away.

50/50, 3 kids, no child support, at the time made almost 3 times more than her.

How did that happen? She agreed because the other guy wanted her to hurry the divorce so they can have sex. (How thoughtful of him and dumb of her)

WV here. Support here is paid on based on your incomes. 50/50 custody will help reduce how much you pay. If you make more than her, then you will still pay some child support.

Also remember that with 50/50 support you get to claim the child tax deduction by yourself (higher earner) unless the court ruled you share it. It is not part of the support calculation in most states and I successfully argued that since the ex and I were going by the book this should extend to the tax credit too.

CA here. Have 50/50. Same as comments before depending on the salary difference determines child support. She was at min wage and I believe my wage was double at the time and my payments were very small. Not until my salary was triple did I get into the few hundred a month. She also started making more as well. It gets really crappy when they claim short term disability, then I think you are on the hook for more. As for what they spend it on, I just consider it gone and a fee for me making an insanely stupid decision. Almost done though. 14 years down and 1.5 to go.

The court system is broken in Georgia. Mom makes $50-80k more than me..both in 6 figures. I got 50/50 custody but the judge ignored the spreadsheet calculations and decided that neither party should get child support. I am sure that if this were reversed, mom would get Child support even if it were $1. Bias against fathers is unbelievable. Youngest is 10 and mom should have paid $1500 until he is 18. The universe is watching.

Mine refuses to work full time just because she gets support. What the courts don’t take into account is she is living willfully in her parents attic and pays no bills so she is effectively able to live off of the support and part time job despite me struggling to live like and adult.

How did you get a custody evaluator? We currently have 49/50 her temporarily and I have no clue why when I’ve been the stay at home dad and primary parent my kids whole life. I’m in Texas also

Generally the higher income parent will pay some support to the lower income parent, even with shared custody.

I strongly recommend that you get an agreement on custody before you start talking about money. Agree on a schedule, implement it, and then negotiate the financial aspects. Try to keep it as friendly as possible.

If you feel the need to bring up child support, try to avoid doing that in writing, or that can be used against you as proof that you “don’t care about the kids, you just want the money”.

WA. State has a calculator for child support. My ex makes about 2.3 times what I do. I got 60% in temporary orders and 50% parenting time in final orders. Judge refused to make her pay child support. She does have to pay her proportional share of healthcare co pays etc….and she does not.

I think in our case none was ordered because both our incomes are greater than the median household income in the County we live in.

I have yet to see none ordered when mom makes less but more than median.

Only if there's a small difference in income.

If you make 6 figures and she's making 44k, they're going to want 20% of the difference of your incomes as the child support.
