I’m still questioning if I made the right call by asking for shuttled mediation; looking back, I wonder if I should have taken the opportunity to complete the session in the same room as my ex. ​Proposed Custody Agreement Framework

​1. Education and Decision Making

  • School Selection: Any change in schools must be a mutual 50/50 decision. If an agreement cannot be reached, the matter must return to the courts.
  • Costs: Funding and general educational expenses will be split 50/50.
  • Legal Custody: While 100% legal custody is my preference, the agreement will specify that both parents share 50/50 joint legal custody.

​2. Physical Custody and Transportation

  • Under 5 Miles: Dad handles all pick-ups and drop-offs.
  • 5 to 20 Miles: The parent beginning their scheduled time is responsible for picking up the children.
  • 20 to 30 Miles: Parents will "split the difference" and meet in a neutral, safe location.
  • 30+ Miles: This constitutes a significant change requiring a return to court for schedule modifications.

​3. Holidays and Special Occasions

  • Standard Holidays: A rotation of six major holidays (three per parent each year).
  • Mother's Day & Father's Day: To be included for the ex’s benefit.
  • Vacation: Clear protocols for school breaks and annual vacation time.

​4. Financial and Medical Responsibilities

  • Insurance: I will resume covering health insurance premiums.
  • Unreimbursed Medical: Agreed-upon costs or medical necessities exceeding $400 will be split 50/50.
  • Tax Documentation: In a 50/50 split, Mom will sign IRS Form 8332 regarding dependency claims.

​5. Religion and Personal Conduct

  • Religious Upbringing: Each parent may make their own decisions regarding religious exposure during their time, provided no harm comes to the children.
  • General Welfare: Both parents agree to act in the best interest of the children’s physical and emotional health.
