How much weight does custody evaluator have?

Most judges, at least where I’m from, really want a 50/50 if possible. A 3% bump for you isn’t going to uproot your children’s lives, I have no idea why the judge wouldn’t just sign off on it.

Judge should take the report verbatim, but:

Mother can hire an expert to contradict the report. Custody reports have been ignored when they have recommendations that contradict the law.

Either party can appeal the judges decision to the Court of Appeals.

That's a good result, technically the recommendations of experts are not binding but they are usually persuasive unless they're deemed biased.

Custody is basically 53/47

Just curious, which state? When I came to this subreddit, I was shocked to learn that some states NEVER give 50/50. They do this so there's always a "non-custodial parent" (NCP), even if the split is 183 to 182 overnights. And when you run the child support calculations, of course, the NCP is sometimes hit hard, despite the virtual 50/50 arrangement.

It's just odd they would come up with 53/47. Why not just 50/50 and be done with it? Splitting hairs at that point. Unless the state has some ulterior motive, some reason to designate you the NCP.

It’s hard evidence. Most Judges love hard evidence. But it still depends on the judge.
