In short yes under domestic violence laws, she would live in house +financial support from you +you pay the mortgage but not forever , especially without kid or cohabitation agreements. But enough to make your bleed financially for a while.

In NJ, Palimony (support for an ex who was never married) requires a written agreement since 2010. So just living together doesn't usually qualify.

Solution?

Risk avoidance: dont live with her especially if she has mental issues as all false accusation pretty much require the accuser to have some mental disorders.
Risk reduction 1: cohabitation agreement before she moves in with rules such as :
1. Owner: you are the sole owner of the house.
2. Exit Plan: You agree on what happens if you break up. "If we split, you have 30 (or 60, whatever) days to move out." This prevents her from claiming she has nowhere to go.
3. No Mooching Clause: Crucially, it should say NEITHER of you will pay the other person support . This makes it way harder for a judge to force you to pay her bills later.
Risk reduction2: Dont Give her the Stick by texting: "get out or I'm throwing your crap on the lawn." In NJ, that's not just an angry text. That's could be considered HARASSMENT, a ticket to getting a restraining order, especially if repeated. Yep, Entry level qualifying for it is getting pretty low those days..

so if u decide to move her in before--> LAWYER up. This is not a DIY project.

Plus if you were already accused of DV, if anothr case was already open against you by your ex, pretty sure her attorney will use it against you to make their case more provant. So Btw don't ever put her in contact with your ex unless you dont mind a collusion/accusation sync against you

OP it sounds like you are asking if you have a live-in girlfriend, things go sidewise, can she get a TRO against you and have you kicked out of your own home instead of her?

Short answer is no. Long answer ask an attorney in your state. In WA and MD, the police would ban you from being near her and then provide her a window where you were not at the house (but you could have a representative there on your behave their to make sure she is not stealing stuff) to gather her belongings.

IF you make her a renter or tenant, then she has tenant rights; don't do that. The only hiccup is are their default tenant laws in NJ. NJ has no common law marriage or squatting rights (well after 30 years or something crazy).

You can (and should) write up a lease in which you have language that deals with termination with XX days notice at Landlords sole discretion or with YY DAYS NOTICE at tenant’s discretion, to be evidenced by a signed termination notice scanned and emailed to the receiving party. You should get a lawyer to help with drafting appropriate language. This really should be easy and protects girlfriend as well, as this provides clarity for both of you. This is also an excellent place to spell out the financial expectations of the tenant. Good Luck.
