Will mediation be worth it if stbx has repeatedly told me she isn’t accepting 50/50 joint parent time? Right now we are only two overnight stays away(a month)to have joint parent time based on our temporary parent time.

You should demand 50-50 custody sharing. Your stbx should be responsible for covering the transportation costs because she removed the children from you. And I cannot figure out what “sole joint custody” means.

Mediators aren’t judges so they do need to help you come to an agreement. That said they can tell her what a judge would do if you don’t come to an agreement and that might help her see the light. But she will have a hard time moving back and undoing her decision so court may need to be an option you consider if she can’t get there in mediation. Good luck!

That is an incredibly difficult situation, especially with the high stakes of a long-distance move and the stress of mediation.

You handled the mediation perfectly: you stuck to the facts (the agreed-upon location, the need for the children to return home) while your wife attacked your character. A good mediator is trained to see through emotional attacks and distraction tactics. If she read everything, she has the full context.

However, the divorce is "getting more messy," and you need to protect yourself now, outside of the courtroom.

Your anxiety comes from the fact that you are hoping the mediator "can tell that I’m telling the truth." In high-conflict divorce, you cannot rely on hope or a mediator's intuition; you must rely on documented proof.

The ex-wife is attacking your character because she has no factual basis to keep the children 500 miles away. She is trying to create a narrative of you being an unfit parent to justify her actions.

Your only defense against her character attacks is to make all future communication between you and her 100% factual and immune to manipulation.

Every time she attempts to engage you emotionally or attack you, you must have a script that refuses the debate and redirects to the fact of the move or the logistics of the children.

You need scripts that:

Refuse Character Attacks: Shut down any attempt to debate your past or present character without engaging.
Enforce Jurisdiction: Factual statements reaffirming that the children's residence should be back in the home state.
Document Her Refusal: Every time she ignores your request to return the children, it must be documented.
