Mediation is almost always the better option if both parties are willing to participate. It usually costs less and results in a better outcome. If you need to, you can have a lawyer look over your settlement agreement, or even have them sit with you during mediation.

The less lawyers are involved, theoretically, the cheaper it is.

But I would involve a lawyer regardless to have them review all docs and agreements.

Depending on where you live, you may not really have a choice. Here in MN you can't just say "lets do court". The judge would first send you to mediation to try to come to an agreement. The last stop is the courtroom.

Just remember with mediation - the mediator is NOT, I repeat NOT a neutral party. They don't try to come up with a balanced deal. Their job is to get an agreement - if they see one that both parties will agree to, regardless if it's lopsided or not, they will push it.

Know what your limits are going in and take notes - refer to them and don't back down on the things you truly want.

Mediation all the way. My soon to be ex and I are just through with it. If you are in agreement on the terms, there’s no reason to litigate. The only ones that will make out in the litigation of lawyers. Mediate all the Way, draft a mutual agreement between the two of you, sign it, be on your way. Legal fees will be 1/10 for that of litigation.

If the two of you can sit down and have a civil and reasonable conversation, mediation can work very well. I will echo, the less lawyer involvement, the better everyone can be

I echo the other sentiments, if she will hold a civil discussion, I'd mediate in a heartbeat. I'd rather have given the money to her than the lawyers, but she wasn't having it, sadly.

FWIW my attorney friend did the paperwork, figured out the deal with his wife, and then went to one of those docujment processors to have them look it over to make sure it's legal. Cost him $500.

"separate ownership" really depends on the state you are in. If you're in a community property state, the value of those assets are considered shared value regardless of who's on the title.

There are exceptions. Some states don't have community property, and if you came into the marriage with those items you may not have to count them as a marital asset. But if you bought them while married, they're very likely to be considered communal.
