I have a similar question. An example will be easiest * couple gets married and open joint account * Wife inherits $100k after marriage and deposits it into her own separate account * During marriage wife deposits another $100k of joint income into same separate acct * But during marriage, wife also spends $50k from that separate acct * at divorce time, there is $150k left in that account How much of that $150k is considered part of the initial $100k she inherited? Is LIFO or FIFO used to determine which amount withdrawals are applied against? Make sense?

When filing for divorce, if my wife and I have never shared accounts since we've married and still have separate accounts, can she be entitled to whatever I may have in my account and/or any stocks I've put some of my money into?

Brother go to court. She cannot refinance and give you the equity. I guarantee it. Sell the damn house and split 50/50. Anything less is you getting fucked.

There’s no alimony in Texas. She can fight for spousal support , but in Texas this is limited to 6 months maximum. and the fact you only been together for 5 years makes it even harder for her to get that. Just be kind and as amicable as possible OP, because a judge can override all this if he sees you as a prick and she’s a victim.

I'm currently going through one in Texas right now. Luckily Texas of a no fault 50/50 split. Did you buy the house together with community money? If so, she needs to pay you half of the equity of the house, and she needs to refinance to get your name off the house(or she can assume it is the loan permits that).

With no children, it's as simple as it gets. You can do the financial split on the back of a napkin: Add up all marital assets and liabilities, then divide by two. You each get half. Divorce is just the division of who ends up with what, like the house, cars, etc. Financial accounts are typically split at the end because they're the easiest to balance out the marital ledger between the two of you.

The biggest question will be spousal support. That is based on the length of the marriage, and the income disparity between the two of you. You can use an online calculator to give you a ballpark number. Be sure to impute her income at full-time minimum wage or her previous employment amount if she is not currently working.

This isn't the time to DIY. You need to hire a family law attorney in your county. Your attorney can tell you what the deal is with your local courthouse judges, because every jurisdiction has their nuances.
