Trial date finally set

We settled last minute.

A court official told her a trial would cost $X. Court official was key. Because she didn't believe me. I have no idea what her lawyer was telling her.

My ex finally settled the day before trial. She drug it out for two years and would have kept it going had I not requested a hearing. I wish I had done that a year earlier.

As an aside, she received much less that what she expected, her 2nd lawyer finally told her to STFU and she was being unreasonable. I don't think that would have happened without a looming hearing.

In divorce, the main purpose of setting trial dates is to apply pressure to the parties to settle. As a rule of thumb, if you're getting within a month of trial, your legal fees will start to build becuase the lawyer will need to begin preparing for the trial. So there should be an offer received or made prior to then if settlement activity is low or non-existent in the interim. If not, then settlement, if it is to occur, will likely happen on the first day of the trial in the judge's chambers before the trial begins. If not, then the trial will proceed and the parties will get a very strong sense of how things are going so more settlement attempts can occur before the court renders its judgment.

From what I've seen, it's the parties themselves that need to come to their senses and tell the lawyers they want to settle. The lawyers will keep marching forward until ordered otherwise. It's also pretty amazing what a phone call and an apology will do for a case, regardless of who's at fault. Trial is up to the lawyers, settlement is up to the parties. Swallow your pride to save 20k.
