A 14-year-old boy beat and raped a 91-year-old woman. He was charged as an adult, convicted, and sentenced to 25 years in prison

This is an interesting case because there is a paradox in rape law where the adult is normally charged with statutory rape and is held responsible (“strict liability”) for the juvenile’s actions. Some states (Indiana included) even prohibited duress (!!) from being used as a defense in statutory rape cases.

Here is one case of the paradox in action. Raymond Garnett is a mentally disabled 20-year-old from Maryland. He has an IQ of 52 making him less intellectually capable than most teenagers. He had sex with a 14-year-old girl who claimed that she was 16-year-old. Raymond was convicted of statutory rape and had his sentence upheld due to “strict liability.” It can also be argued that the girl took advantage of that man but this was never considered at all.

The Dissenting appeal opinion made a remark that the defendant’s 14th amendment rights were violated because he was not given due process and swiftly labeled a rapist despite his mental state and despite him being misled that the girl was 16.

Slide #6: "Ok what did you read, I'm talking about the fact that a 15yo girl said "It's my fault, I seduced him, I got him drunk" I don't care how care how drunk one gets there is no amount of alcohol in the world to make even a mediocre drunk enough to rape their doughter"

In other words, if a female gets a man drunk and rapes him he is still at fault. Now if a man gets a woman drunk and rapes her, he is at fault and rightly so. See how this is a double standard that results in the stance that men cannot be raped?

In other words, men can't be raped is what that comments are saying.

So, where is the missinformation and how is it that only men are spreading it? You seem to be doing a fair bit of it as well.
