Accept that most crimes aren’t provable in a court of law.

A good start would be to keep the plaintiff and the defendant’s names confidential, that way it’s not media circus.

Due process is essential to a free society. Better some criminals that are guilty are set free than send innocent people to jail.

Filing a false police report is a crime, but it’s often not enforced. For example the women who falsely accused the Duke lacrosse players was never prosecuted for doing so even though she perjured herself in court.

Being held responsible for making a false report is only a deterrent to false reporting. It shouldn’t deter actual crime reporting. As I understand it filing a false report only applies to filing a knowingly false report and doesn’t apply to honest mistakes such as misidentification.

Law enforcement and the DA simply need to be as serious about the crime of false reporting as they are with other crimes. The current problem is people can make false rape accusations knowing the odds they will get in trouble for doing do are incredibly low. This encourages false reporting.

I see no dilemma. People who commit a crime, whether it be rape or the crime of filing a false police report should be investigated, and prosecuted by the rules of due process.

Everyone gets due process.

That means people accused of rape and people accused of falsely accusing someone of rape.

uk (my) law states there must be evidence that exceeds any reasonable doubt. edit: as pointed out, ideally, this would actually be true

it only stands to reason that, if we were to start prosecuting false accusers, this would apply to false accusers aswell. realistically, in like 90% of rape cases, both parties would just end up walking away due to the difficulty of both proving an allegation is fake, as well as proving a rape did take place.

i just find it most disgusting girls can openly admit to creating a false allegation and still get to walk out of court with their identity hidden and protected. there is ZERO justice for the accused, and these aren't even scenarios where you can argue it'll make actual victims less likely to come out.

I dont know if "funny" is the right word for this, but heres something to think about:

You know how Feminists love to say that Women would NEVER falsely accuse a Man of rape? Well, if Feminists were right, then this sort of thing wouldnt be a problem because only ACTUAL RAPE cases would go to trial. BUT, because it seems to actually be a problem here, Feminists must be wrong and Women ARE falsely accusing Men. Weird that huh...

In answer to your question: EVERYONE is entitled to a fair trial. So in theory, after the accused is found not guilty, then there would be a 2nd trial to see if the "victim" has made a false claim or not, based on that first trial. Obviously in reality, "Fair Trial" isnt something we see too much of, but thats a seperate issue here...

But, if such a law is created then women might get more afraid to file true rape cases, especially against powerful people.

Accusers would be more likely to be believed, since they couldn't just make up stories with impunity.

The issue isn't the rape laws but the administration of them. A rapist of either gender should be in jail

I have another question for you and everyone else. Why is the rape of a woman more important to us than the destruction of a man's life who has been falsely accused of rape? And one more. When a rape accusation has been proven false why do we pay more attention to the theoretical damage it causes to rape victims credibility than the very real damage caused to the man who was falsely accused?
