Laws are not implemented or enforced for the Public Good, they are implemented and enforced to increase the legitimacy and power of the Government first and foremost.

The trick is to make the Public Good into something that increases the power and legitimacy of the Government.

They are. It's just that prosecuting false accusers is generally considered to be "not in the public interest".

That is, prosecuting false accusers is considered not as important as prosecuting people accused of rape. Even though it's absolutely abuse, using the State and its machinery as the implement of abuse.

It's either filing false report, perjury, libel, slander or defamation depending on how, where and to who you make the false accusation. It isn't fraud unless you use the accusation to gain some other benefit from a third party.

Yeah the government are happy to convict “victims” of sexual offences when there is no evidence. And even contradicting evidence. BUT not happy to prosecute anyone accused of a false allegation because well... it can’t be proved ( other than them literally admitting it) even then it’s not in the public’s interest apparently...

Because a false accusation isn't a crime at all.

At best the police might charge someone with "wasting police time" if in fact they wasted time, or some minor offense but only if the accusation was made to the police. But if it was only made to college authorities say, there's no crime committed.

Because one can be mistaken. It's possible to accuse someone of stealing, and be wrong. The thing goes to trial, both parties are identified, a jury decides. The verdict is published.

Because then women would be too scared to report if they get sexually assaulted. Imagine getting raped and then going to jail for reporting it.

One is a crime, the other a legal code infraction. Legal code infractions can get you on a blacklist or to pay fines

To be sure, laws are there to enforce common ethics . Don't lie, steal.. most humans are not raised to control their own emotions much less, rules, guidelines, or laws.

Intent is difficult to prove. A false accusation where she believes she is correct is not fraud even though it is a false accusation. For it to be fraud there must be intent to defraud.

If we want a different, more specific criminal charge I am all for that but fraud is not the best legal route.

Now Civil suits should be going on each and every time. False accusers should be bankrupted by the courts.

You wanna look up the legal semantics for fraud and libel and false witness . Then things will begin to make way more sense. Don't get emotional about it - try to understand the legalese first. It is not easy to get it correctly and to understand the various important implications.

Because when most women won't report an actual rape, and with it being so hard to prove, making them afraid of legal retaliation will probably make them even more afraid of reporting it.
