Yes, but a favorable outcome is highly unlikely.

The state doesn't care what's fair or right. It just wants some man to pay child support. If it's Bob's semen, Bob pays. If it's Tom's semen, but Mary says Bob's the dad, then Bob pays too, unless he gets a good lawyer.

Google "paternity fraud" for more info. There is existing case law on exactly this scenario.

I know I've read this exact case somewhere, but my Google-fu is failing right now. IIRC, the court decided that the sperm was a gift from the man. And that legal ownership of the sperm was the womans, thus hers to do with as she pleased... one turkey baster later, courts ruled that there was no difference between oral and vaginal sex. He was on the hook for support.

The way I see it(though, this certainly doesn't seem to be the way most people see it), that is his seed/DNA, his identity/legacy, it is a part of him and an extension of his body; he should always have complete ownership of that seed(Even after it's ejaculated). If Mary used bob's semen for purposes that he did not consent for, that is a form of theft as well as fraud. Not only should he automatically be exempt from paying any kind of child support for that child, but I believe he should have legal grounds to both declare her as an unfit mother(basically, that she has proven herself to be too irresponsible to care for a child; possibly forcing the child to child protective services) and/or have her charged and sentenced for theft, fraud and any potential emotional/financial damages(putting a guy through that ordeal would certainly cause some stress and emotional damages).

I doubt it could ever be possible for the state to force Mary to have an abortion but I think that should be offered as one of the possible forms of resolutions; she should have the option, or choice, to return some of those damages done via abortion but, if she cannot or is not willing to, she should be liable to reimburse/compensate the victim for the damages done and stolen property.

He has no right to his sperm once it's left the tubes. I think there was a court case a while back that set the precedent for this, I know it showed up in another thread.
