No I know I fucked up trust me I know. But I'm trying to find the actual law stating it. This is what I find about it "The actor causes submission of the victim by threat of imminent death, serious bodily injury, extreme pain, or kidnapping, to be inflicted on anyone, and the victim believes that the actor has the present ability to execute these threats;" since there is no custody order or any issues with that it isn't considered kidnapping.

§ 18-3-402. Sexual assault

(1)

Any actor who knowingly inflicts sexual intrusion or sexual penetration on a victim commits sexual assault if:

(a)

The actor causes submission of the victim by means of sufficient consequence reasonably calculated to cause submission against the victim's will; or

(b)

The actor knows that the victim is incapable of appraising the nature of the victim's conduct; or

(c)

The actor knows that the victim submits erroneously, believing the actor to be the victim's spouse; or

(d)

At the time of the commission of the act, the victim is less than fifteen years of age and the actor is at least four years older than the victim and is not the spouse of the victim; or

(e)

At the time of the commission of the act, the victim is at least fifteen years of age but less than seventeen years of age and the actor is at least ten years older than the victim and is not the spouse of the victim; or

(f)

The victim is in custody of law or detained in a hospital or other institution and the actor has supervisory or disciplinary authority over the victim and uses this position of authority to coerce the victim to submit, unless the act is incident to a lawful search; or

(g)

The actor, while purporting to offer a medical service, engages in treatment or examination of a victim for other than a bona fide medical purpose or in a manner substantially inconsistent with reasonable medical practices; or

(h)

The victim is physically helpless and the actor knows the victim is physically helpless and the victim has not consented.

if you had coerced without holding her own son over her head, for christ sake, you would not have raped. But you raped her the minute you gave her an ultimatum that involved her having sex with you. This is the same as how a woman can do this to a man and it be considered rape. Not all rape is tying someone up or holding them down.

Yes, I know what I did was morally wrong. I know I fucked up and chose to do something I would never normally have done. I'm asking about legally what I can find is that it's not kidnapping because I have equal rights in colorado. If she would have said no to me taking him and had a custody order then It would have been different. So it isn't technically coerced sex. I'm asking if I am reading the law right.

This is an interesting predicament. I would like to be clear in saying that her having sex with you is akin to torturing someone. They will tell you what you want to hear but it doesn't make it true. i won't comment on the morality of it but I will say it is ineffective at the very least.

An interesting thing I would like to point out is the reaction of outrage whenever sex is involved. I could see this scenario going a variety of ways that involve some sort of coercion but not sex.

I have always found the idea of coerced sex classified as rape to be a slippery slope at best. The main problem I have is that it takes away the agency of the actor acted upon. I am not saying this is permissible, but I don't know if I would put it in the same severity as rape considering that if you take sex out of the coercion and make it about something else the legal ramifications become significantly less.

I do understand and empathize with you but this my friend is not the way to calm your insecurities. Trust is a fundemental aspect of keeping your marriage together and will be the most difficult thing to repair. You can think of how you've been wronged and what it just and no one will blame you, but what good does it really do? What is best for your son? If it means being the selfless one, the forgiving one at your own expense so that your whole family has a brighter future isn't it worth it? I don't know what kind of woman your wife is and I don't know what kind of man you are, but I know we all make mistakes. This is an opportunity for you to show your wife and son the depth of compassion and forgiveness you are capable of and the caliber of man that you are. I can not promise you that by being self sacrificing your wife will come around, but you will be the role model your son desperately needs.

I'm sorry I do not have legal advice for you, but perhaps if you are selfless in this situation your wife too will show compassion and not pursue this legally.
