Maybe not a legitimate pussy pass, but it’s some kind of pass. She should definitely be doing more time to learn from her “mistake”. But nope, guess she’ll be back on the road after her license suspension is up, ready to run over more children. But at least she’ll be able to care for hers, right. My point is she deserves much more of a shock to her system than a 4-year sentence. If someone was careless enough to drive a bus of children while distracted, and run over 3 kids, that’s not a fucking accident. It’s a result of her choosing to be a careless POS. Bad, careless choices = bad consequences. I’m aware of lighter sentences sometimes being given to those that plead guilty, but she even plead not guilty.

Why should it be considered any sort of violation of the law anyway? It's not a hate crime because the guy isn't deliberately going up to gay people and harassing them. It's not disturbing the peace because he couldn't be interupting anybodys activities by just burning a flag near them. It isn't vandalism because it's his own.

It's more complex than the title says.
He threatened to burn down a bar, then proceeded to steal the flag from a church, take it to the bar, and set it on fire. So he got charged with arson, harassment, and reckless use of fire. The arson charge was aggravated by being considered a hate crime... since the guy decided to state in court that he chose the LGBT flag to send a specific message to those groups... which I'm sure made his lawyer facepalm.
He would've gotten 5 years, but it was his 3rd offence (previous 2 being felonies), which tripled his maximum sentence under Iowa law, so he got 15 years.
I still disagree with the sentence, doesn't fit the crime, at all, but it isn't as simple as "guy sets LGBT flag on fire, gets 16 years" like the news article title makes it seem.

He was found guilty of harassment. Regardless, that was irrelevant (30 days) when it comes to the total jail time, so I'm not sure how do you claim that it "conveniently allows them to proceed with their kangaroo court". He still stole a flag from a church then set it on fire within the bar's property. That's arson, plain and simple. You can burn a flag if it's your flag, you can't steal someone else's flag and burn it, and especially not if you're also gonna burn it on someone else's property.
I can't steal a flag from your neighbor and set it on fire on your lawn and expect to not face any punishment. The fact that he was a repeat offender, and that he decided to state in court that he chose it specifically because he wanted to send a message to LGBT groups, and then later also decided to state that he'd essentially do it all again, are what lead to the higher sentence.

Without the link to the actual proof of these two statements we can only speculate, but burning a flag is very much not illegal in the US. Not excusing he ridiculous sentence that the women got here, but there is more to the mans side of the story here.
First he stole the flag from a local church, which added to the sentence, secondly he has two previous felonies on his record which drastically increased the length of the sentence, and lastly he stated that if given the opportunity he’d do it again which probably did motivate the judge to give him a lot of mercy.
