The problem I see though is the prevalance. Mary Kay Letourneau assaulted a 12-yo in 1996. It was a huge national scandal and unlike recent cases, was on the news for both months and YEARS.

This 29-yo Dixie McCullough was 7 at the time. She grew up hearing about regular cases of sexual relations between female teachers and male students, knew the scandal, knew the law, and knew the consequences. Her norm was female teachers are criminals when they have sex with male students.

She knew and possibly planned it out and that makes her an actual predator.

That's a loaded word that means something different to different people.

Laymans term = consent means were willing participant

Some peoples term = consent means willing participant that fits also within a specific legal/moral framework that changes over time. If it's not viewed as morally right by the viewer, then it is not consent. This is where we get things like "2 consenting adults cannot possibly consent IF there is any kind of power imbalance in the relationship."

For example: When I was in the military, there was a Sergeant (E-5, NCO) fraternizing with a PFC (E-2, Jr. Enlisted). They got caught having sex in the barracks. They liked each other, and when they got out of the military they got married and have been married since. However, MANY proponents of the second version of consent would say that he raped her because he was in a position of power. Even if she consents to it whole heatedly, her feelings on the matter are irrelevant, she could not have consented, she did not have that authority to do so, she was raped full stop. Because he was in a position of power over her.

People are on different pages on these conversations because they don't really define their loaded terms lol

There was no rape. Position of power or not when you say someone can't make decisions on their own agency because you said so and then you paint one of the consenting adults as a rapist and the other as a victim against what they believe in you have a problem. Especially when you discount the "victims" feelings and accuse their partner as a rapist. Now yeah it's not good for managers and workers to have sex with each other not because of position of power but because of conflict of interest. Using the word rape just cheapens real rapes. This twisted logic that you seem to distance yourself from is just that.

Now obviously we decided as a society that having sex with kids is wrong and we picked an age of consent. You have to draw the line somewhere and you're right it does change depending on circumstances.

Well this actually isn’t an example of an unfairness that we should change.

Even if a 16 has a kink for an older partner in a position of power, we should not be changing our laws to facilitate that relationship.

As a society we have already determined that harm of allowing individuals in positions of power to have relationships with those subject to their power to socially undesireable.

The fact that a minority of 16 years olds believe they have a kink doesn’t they have given valid consent. Even if it did, the potential harm in allowing individuals in positions of power to have sexual relationships with 16 year olds (including those who don’t have this kink) far outweighs the marginal, if any, benefit of allowing the minority to pursue these types of relationships.

Sounds fair to me.

What is this new phenomina where if someone is seen in a potential "position of power" that suddenly anyone "lower" than them can't have sex with them since they can't concent? Did being a human being go out the window?

What about having sex with your teacher to get an A? What about having sex with your boss to get ahead?

I guess by this logic I shouldn't invite or hang out with anyone "above" me at my job because they have a "position of power" over me so somehow that means are interactions aren't equal.

But yes, sure, having any age of consent is relatively arbitrary since you'll always go from unable to give meaningful consent to able to overnight. That doesn't mean that the age of consent is pointless and should be ignored. I don't know why you're so set on supporting the rights of teachers to sleep with their 16 year old students.

Except the male teachers life is ruined and ugly mugshots are shown in news reports. The encounter is called what it is. Preying on a minor from a position of power. The girl is treated as a complete victim. Sentencing fir this crime is harsh.

I didn't say this at all and high schoolers hooking up with each other is not at all the same as a 29 year old sleeping with a teenager. Try a different argument, maybe counter one I actually made.

In the US, by law a minor cannot, outside of very specific circumstances (Yes, I'm aware of Romeo/Juliet laws, etc), legally consent to a sexual relationship with somebody significantly older than them.

Do you honestly think a 29 year old and 16 year old are entering into a relationship on equal ground? How do you rationalize it?

Even if it was "just" an age issue most US states have laws against high school teachers sleeping with their students.

Maybe something to do with high school students still being emotionally vulnerable children. Maybe it has something to do with professionalism. This would have been legal in my country, where the age of consent is 16. She’d probably get fired for being unprofessional.

The age of consent in Texas for sexual activity is 17+-3 for similar age. There is also a law that specifically forbids student/teacher relationships for high school and below.

She could not have been entirely unaware of those things seeing how much consent and sexual assault training everybody goes through.

A power imbalance can exist but the state has significantly less ability to control sexual relationships between two people 18 or older and not in high school.

I'm not sure what you're trying to actually argue and I'm not too keen on presumption but it sounds like your argument is this

Sixteen year olds should be able to consent to sexual relationships with people older than them. Two years isn't such a long time anyway and eighteen is such an arbitrary number so why does it matter if this teacher sleeps with her students

Feel free to correct me if I'm wrong.

The issue is this. The age of consent in most areas was chosen based on an age where the majority of people are seen as legally and mentally fit to make most (or all) of their own decisions.

The age of consent in Texas happens to be 17. Even then there are significant restrictions between 17 year olds and people who hold authority over them, not in "maturity" or "life experience", but actual authority. This includes roles such as teachers, coaches, adoptive parents/guardians, etc.

The male person this woman chose to sleep with was 16 and was her student. That is literally the entire issue.

If you want to say something like "but they wanted to start a relationship, they should have the ability to do that" answer this.

I'm sure even after they graduate a bunch of 17 and 18 year old boys would still be perfectly ok sleeping with their ex-teacher so, if her goal was not exploitation of an immature male, why was she unable to wait 1 (or 2) years OR wait for him, and potentially dozens of other boys, to graduate high school before sleeping with him?

It isn't exactly arbitrary, they drew the line at a particular age because the legislators making the law decided most people under that age are not mature enough to understand what they are consenting to.

It isn't sleeping with people in general, just sleeping with people far outside of their own age/social group. That is why, for example, Texas allows teenagers at the age of 17 to sleep with people within four years of themselves (but not under 15) which would be, for a 17 year old, anybody from the age of 15 to 21. I don't have so many issues with that.

What I have an issue with is the very obvious age/power imbalances. There is very little reason for a significantly older person wanting to sleep with a younger person other than some form of exploitation.

If there was a "legitimate" chance for a relationship I feel like both parties would be capable of literally just waiting a few years to avoid a felony.

That said, I’m sure many Europeans would find it detestable for a grown man to sleep with a girl barely in puberty, legal or no.

Not sure.. it seems unusual. Maybe it has something to do with them being employees of the city/county/local government, similar to how police and such get put on administrative leave instead of being fired. Workers in these kinds of positions seem to receive special treatment compared to everyone else.

If you think about it, a teacher isn't a lot different from a pastor. They're both in a position of authority and can prey on minors who trust them just the same, regardless of the danger/manipulation factor. Pastors register as sex offenders, but teachers don't. Seems to be some disconnect here.

Actually this happened at my school years ago. He was the hot soccer coach and math teacher and she was thirsty as fuck. She talked once how she loved every minute of it, however it was only the male 25yo teacher that paid the consequences for being seduced by the hottest girl in school.

Was he legally in the wrong and should have known better? Yes. Do I think he did anything morally wrong? No, because he wasn't even her teacher and had no affect over her grades. However, he still did deserve to lose his teaching position due to his position, but I don't think he should be labeled a sex offender for it.

Most of the world sees 15/16 as the proper age of consent, and I would have to agree. Is it still weird for a 30yo to get with a 16yo? Yes, but it's even weirder for a 65yo to get with an 18yo and that is completely legal.
