What protections for men is she thinking of? The woman gets all the benefit of the doubt.

As far as I can tell, her goal, for whatever reason, is to give women absolute power over men they are in relationships with?

She wants the sole determination of whether there was a rape to be the woman's later thoughts about it.

Rape ought to be about force, power, coercion, or drugs. I mean, for something to be rape, the man HAS to be trying to get something he believes the woman doesn't want, or (for arrogant/optimistic types) doesn't have adequate reason to believe she wants.

This is just crazy. Like Machin said, turning over "presumed innocent".

I am not sure that some readers are grasping the gravity of this proposal. Why is it important that we understand? Because prior to the internet and Glenn Sacks et al, back when men were sleeping on their rights because they didn't know what was going on behind their backs, a host of harmful laws were passed under our noses (Fed.R.Evid. 413 comes to mind). Now we have the means to be alerted to what is happening, and we need to be ready to battle this one with more vigor than any we've ever battled if somebody tries to get it passed in some state legislature:

Under this proposal, it will be your burden as the defendant to convince the trier of fact that the woman consented. And since consent generally is the entire case, that means you have the burden of proving the entire case. The presumption of innocence will have been turned on its head.

Which means, your right not to testify has been effectively taken from you. If you don't testify, you will almost automatically lose, and you will go to prison for years.

More fundamentally, if the jury doesn't know whom to believe -- as is often the case in these "he said-she said" cases where there is no other evidence or witnesses -- you are going to prison for many years.

Gentlemen, if this became law, you likely would go to prison anytime a woman decided to cry "rape."

One of the most dangerous fallacy held as true by the American people is "innocent until proven guilty" is the law of the land.

I spent 485 days wearing an ankle monitor and under a 14 felony count of rape of my wife and daughter. My daughter gave a contradictory account of what happened, but insisted, over the leading questions of the interrogator, that there had been penetration. Physical evidence contradicted this, but still the DA went forward to trial.

My daughter testified first and my attorney set a good foundation for the crux of my defense, that this was a fiction created by my ex-wife. The DA called my wife next and during cross-examination my lawyer hammered home the issues that made it clear that this was not true. Over the lunch break the DA reached out to my lawyer and agreed to dismiss the case in exchange if I would first agree to plead guilty to a separate case of Domestic Violence Assault and Child Abuse, No Injury. Both were misdemeanors and I spent four years on probation, but it was better than facing even the chance of going to prison for the rest of my life for a crime I did not commit.

My lawyer told me that he commonly gets asked how he can defend the guilty. His response is, "All of my clients are innocent." When this is greeted with the usual incredulity he continues, "Everyone is innocent until they are proven guilty."

We have about three thoughtful intelligent women who self-identify as feminists on Reddit. This woman also self-identifies as a feminist.

Feminism has run its course. It is time for women who want equality to call themselves something else and leave the title of feminist to the other 99%, the man-hating bull dykes and the victim complex hypocrites.

"Most rapes are of the acquaintance variety, and consent often is the sole issue in dispute in a rape trial. Under this professor's plan, if a woman alleges rape, nonconsent would be presumed, and the man would be required to show by a preponderance of the evidence that the act was consensual."

As if people don't change their minds about whether sex was a good idea or not after the fact.

This is one of those things that could never actually happen. Shifting the burden away from the state to the accused would be struck down by every court in every state.
