TL:DR - In Florida (no-fault state). Ready to move on after 20 yrs. Have 4 kids, 2 boys, 2 girls, aged 17-10. I have current significant health issues requiring expensive medical supplies monthly and a future, major surgery to be whole again. Wife makes marginally more than me for the last few years due to COVID and my health crisis. She's a teacher and we have health insurance through her work, I'm self-employed. Home is a rental, no major assets. I'd gladly let her keep all the furniture and things in our home. Debt that is in each of our individual names kind of canceled each other out.

My goals:

1) Get the hell out of there ASAP/once it's financially viable for me. Being with her in this dead marriage affects my mental health, which affects my physical health.

2) I also have a budding, commission opportunity/business that I want to make become my full-time venture and build into a real, brick and mortar business. Right now, in short order I want to protect the little and growing income I have from being considered marital income, regardless of when separation actually happens, make damned sure sure that I have all my expenses subtracted out so that I can protect my cost of sales and keep things growing so that I can be successful once my mental and physical health are back to or near 100%. I don't know if family or divorce courts care about P&Ls and cost of sales, but if they consider all my commissions as straight income, I am screwed;

2) To get 50/50 custody with having two of the kids come over at a time for a week and alternating the boys and the girls (we are in an expensive area and both of us will only be able to afford a two-bedroom apartment immediately after divorce). From what I've read, I'm worried that leaving, even with my kids being 10 and older to almost graduating high school, I could lose all custody of them if I leave the house;

3) Pay as little to her as possible, even in terms of child support, given the desired 50/50 oitcome for custody, and my need to get my own health insurance and pay for my medical supplies.

Questions:

• Would leaving the "marital rental home" put me in jeopardy for the desired 50/50 custody?

• How worried do I have to be about commissions being taken as straight income without the expenses being considered/how do I protect myself so the divorce doesn't extinguish my business while also causing me to have payments to my spouse each month that I can't afford? Being able to earn these commissions is what is going to allow me to get that divorce and set up the home for my kids.

I know I have to get out of this marriage for my mental, emotional, and even my physical health, but I'm a little concerned...

Please exercise patience with me while I give y'all some background, current state of things, and financial info...

BACKGROUND Live in the great state of Florida. Married 21 years, 4 kids (17 on down to 10). Marriage has never been great--NEVER. I was head over heals, and either missed or chose to ignore red flags leading up to the wedding and stupidly started having my children with her even after I knew better (what the hell was I thinking!?!? Did I really think more love and time would move the needle?!?!?).

Long story short, I had a health crisis last year (lost part of my colon to cancer in early 2021, am now cancer free) and am currently medically needy (colostomy bag while remaining colon heals, complications to get the reversal surgery, might take me a year to get surgery and become "whole" again).

In a nut shell, I have gained some incredible clarity regarding my life after a near death experience (had to be resuscitated 2x during colon surgery, and then in a medically-induced coma for a few days while being stabilized), and decided I could no longer tolerate:

• A clinically sexless marriage, as in ~10x per year since after the honeymoon, except when trying to conceive (maybe that's why I went ahead and had 4 kids with her, I was betrayed by the thinking of my "small head"). Never saw that coming, as we're conservative Christians, so no full-on sex before wedding, although I'd been sexually active myself with girlfriends prior during some rebellious years as a young adult;

• No real personal transparency and intimacy emotionally from her side. Relationship very transactional. She wanted to be a stay home mom, but 2007-2008 happened, we lost our business and our rentals. She went back to work in 2014 when youngest was 2 due to circumstances. She's loathed me deep down for this ever since;

• Her damned mommy issues. She always has to move her mom near us and wants to "biblically honor her mom" by financially providing for her. The first big betrayal was that, early in our marriage, wife and her mom tried to sucker me into giving MIL a rental house (had a $200,000 mortgage on it that I was paying, too) back up north early into our marriage. Also had to provide 3 cars for MIL because wife can't work unless her mommy can "help" with kids. Nobody else is good enough, mind you. I would have left after the betrayal of attempting to gift the house, but we had two kids by then, the eldest and one in the oven.

• MIL is a narcissist who verbally and emotionally/psychologically abuses my kids (found out too late in the game that MIL also did this and physically abused wife and her brother when they were kids). Wife always puts her mommy ahead of me and the kids. MIL and wife had told the kids for years to lie to me/not tell me how Grandma treats them, because "your dad will get angry and not let Grandma see you guys anymore." Again, I was scared s#@less I'd lose my kids to these crazies;

• More BS she does, but this is getting long...


CURRENT STATE OF THINGS Conversations have been had regarding every single one of our issues at least quarterly over the years, but she either says, "Yeah, yeah, I'll work on that" or she just kind of listens in silence, gaslights me, or--increasingly common in the last 7 years--she angrily threatens me with divorce and wants to take these subjects off the discussion table entirely.

In July 202 II called her out on EVERYTHING all at once and true to form, after some intense yelling on her part, she defaulted to jer go-to tactic and pulled the "D" card on me trying to shut me up. I'd finally had enough and said, "You know, maybe this does need to end."

Now, because I want to demonstrate to God, myself, her, my kids, and my faith community that I have done everything to save this marriage, we have been in marriage counseling with our pastors since August. Counseling is making things worse. She's lying--outright lying to the pastors' faces while simultaneously gaslighting me. Since she knows sexlessness is not OK, she's also been doing what I believe is called hypersexual bonding, and--after telling the pastor, "I've.really been upping my game in the bedroom, actually did start trying to do so, initiating the same wham-bam quickie sex as always but now 1-2 times weekly so she can stay in good with the pastors and continue to appear like a good little Christian wife.

We've gone over the mommy issues, including the MIL's psychological abuse toward kids, the deception and lying, etc., with the pastors, and they have admonished her to 1) get counseling and 2) stop being "deceptive." Older pastor went light on her, wouldn't use the words "lying" or "lie." Pastors also subsequently went light on her when she said she didn't think she was ready for counseling on her mommy issues yet.

I'm.working with a July deadline for calling it quits--one yeat of counseling.

However, what's bringing my desire to get into full research and prep mode is that she lied to the pastor in front of me again (she will never ever admit she's wrong or admit to a sin, but will gas light and lie to avoid making herself look bad or facing the reality of her own fallen state and shortcomings). She also spent a crap ton this Christmas, running up a credit card of her own and spending.cash while letting bills go into arrears (I opened the mailbox to final cut off threats for the utilities onde day mid-January, and. I 100% took over the finances. Oh, yeah, and she's also trying to ply me for a new car!


FINANCIAL SITUATION Lost my job in January 2020 and then COVID kicked my ass so that I couldn't get another comparable one my ass, then my health crisis in 2021 and the trauma of seeing my marriage finally for what it is... I've basically been working gig-wise and make the exact same as what my wife does as a school teacher.

No assets--wasn't going to make the mistake of buying a house with her when we came to FL, and our retirement had been the rental propert9we lost in the Great Recession. Her 2012 minivan is paid off, but is at the end of its useful life. Still paying on my modest 2017 car. No retirement accounts.

I am trying to start a business, but am not really pushing it, since I know that could be bad for me. We are just barley getting by with no extra. Kist debts and pay check to pay check. Wife is finishing Masters to become a vice principal/administrator, so I guess we both have opportunities to earn greater income.

I really need health insurance with my medical situation (colostomy supplies alone without insurance are 600+/month), and the 4 kids and I get insurance through her with the school district's Blue Cross/Blue Shield "Cadillac" plan.

Neither of us could currently afford the 3 BR rental we live in now as divorced people (we have 2 kid of each gender, so they share rooms), and I want 50-50 custody coming out of this--hopefully they'll allow two kids at a time foe a week/two.weeks at a time in a 2 BR, all that either of us as divorced cab afford currently.


QUESTIONS

So, with my July/Aug deadline mind, how do I start getting ready?

Is it true I can see all the best lawyers first, one every other week or so, and block her from signing them due to a conflict of interest?

With the age of my kids, is it still critical I stay in the marital rental home until there's a decree? Kinda eant to leave so my business commisions won't be counted as marital income due to separation, but worried about her and the MIL going batshit crazy.

With her marginally higher income, my medical needs, and no assets, and me wanting 50-50 custody, what could alimony and child support look like?

Any other tips I should know?
