Long story short, married 12 years in WA state, no kids. I make great money, she hasn't worked in 12 years. I filed Feb 1. To me this whole thing is simple: 50/50 split of all assets/debts + spousal support. But she has dragged things and refused to talk. So refused to even discuss selling house in May-July, so we missed the bubble / peak market (likely at the cost of $100-200k). She keep pushing back or cancelling mediation, which is now finally scheduled for Sept 7th. Her new attorney (her first withdrew for unknown reasons on June 2nd) and my attorney are offering to sell / list the house before final settlement, place the funds into a trust that neither party can touch until final settlement is reached.

  • Our court date is scheduled for Jan 3 2023.
  • I currently pay $10k/mo in court ordered temporary support + $4700/mo for the mortgage.

Does selling the house before a final settlement make any sense? My concern is that she can 1) Request a modification of temporary support (after all if the mortgage disappears I can pay more) OR 2) What's my leverage (if any here), she can move into temp housing, collect the temporary support and wait for the clock to run out (court order in Jan) for the final settlement to be ordered which WILL BE A 50/50 SPLIT (that's the law in WA). And I'm not likely to get a credit for my temporary support; so she could be setup to collect a few extra months of free support.

I asked all this to the attorney too, but haven't heard back from them. Just wanted to get some random opinions too. I feel like if she was willing to do this back in May-June when the market was hot it makes sense (Redfin estimate $1.67M) but now there's more risk then benefit for me (Redfin estimate $1.5M).

_EDIT: LOL - so I just got a email from her lawyer saying since we are working on things and might be able to work out a deal, can we push mediation back to early November :) Ok I suspect this is all BS. So we need all of Sept & Oct to work out a 50/50 split of assets/debts and figure out a number for spousal support??? Fuck that, I am leaning towards no partial deals. We can work all this out in mediation OR with back/forth emails; but I think we need to just work it ALL out and be done. And if that means before a judge Jan 3rd so be it. Waste of my time & money, but I can accept that. She already lost a ton of money by dragging things out; so she can stay in the super house for free for a few extra months and it will cost me like $75k more, but don't care. I can always make more money. _
