Hey y’all, long story short the STBX filed for divorce a couple weeks ago. Have been separated for 9ish months. We bought a property in south GA after the marriage in 2018 and in 2021 I refinanced it in my name only, planning to make it a rental after we moved from that spot, (no intention of trying to keep my wife out of it, just made the refinancing process easier) but in mid 2022 things really got crazy and she left with the kids to Atlanta (parents house). I tried to play all the options in my head and talked with a couple of layers/attorneys and they told me even though the property is in my name it’s still a marital asset and wether I sold or rented it out she would be entitled to half of it. Currently: I have decided to sell it because it’s the most I would get out of it in a while due to the house market and just crunching numbers it’s was the best option for if she did divorce (which now I know she is going to divorce) and I have gotten different answers from other people saying I don’t have to give her anything since the property was in my name after the refinance. Is this true? Anyone in GA with a similar situation, would love advice on if selling it is best or try to keep it? (It’s close to being sold but not yet)
