I really don't think a sperm donor has any right to a child. However, it seems like Jason Patric wasn't that. He was in a relationship with the woman, they used in vitro, and he maintained a presence in the boy's life. That's not a donor, that's a father. Donors provide their sperm and have nothing further to do with the process or child, let alone a romantic relationship.

This is off topic, but I love the hypocrisy of sperm donors and child support.

A man can relinquish his parental rights by donating his to a second party, who then sells the sperm to a third party. Genetically, the child conceived is his, but he's not responsible for support. This is considered to be in the "best interests of the child".

A man has sex with a woman. A child is conceived that is genetically his, he is responsible for support. This is considered to be in the "best interests of the child".

There is some magical difference where the child is concerned between sperm and sperm straight out of a penis.

OK. So. We have three different topics here that are being lumped together. First are anonymous sperm donors. These guys agree to hand over their sperm and call it done at the counter. They have no parental rights. Nor should they.

Second are men known to the people whom they donate to, or selected by those people, who agree to provide sperm so that this parent or parents can conceive a child. This relationship also ends at conception. The biological father, in this case, also has no parental rights. Nor should he.

Finally, there is the third group. Men who have a relationship with the woman in question. It may or may not be romantic, but the woman agrees that the donor will not be just that. The donor will also play a significant role in the conceived child's life. This may or may not include financial support. These are not donors. These are parents. These are fathers. They have parental rights and those rights should be respected and supported.

I have no idea which of the latter two groups Jason Patric belongs to. I'm certain it is one of them, though. I'm also certain that somebody in this case is a big fat liar. I just have no idea who.

Sitting beside Schreiber was her lawyer Patty Glaser who explained why the "facts, the law" and "common sense" are on her client's side in this case. "The law in California could not be clearer. He had an opportunity prior to the conception of this child to say, 'I want to be the dad.' He said 'no.' He not only said 'no,' he said, 'I want to keep it a secret.' And then right before the child was born, maybe four or five days before the child was born, he says it again in writing: He doesn't want to be the dad.
