If you're a man then good luck getting your support lowered. It can happen. But, it's not nearly as automatic as it is for mothers.

Yes! It can be done. If your spouse agrees to the new deal, then a judge doesn’t need to decide it. Which state has jurisdiction? Have you used the software to calculate the new support numbers?

Afaik 1) if you both agree to a new number then a judge should sign off on it 2) in New Mexico, you put both parent's income and # of overnights into the state CS calculator, and it spits out the monthly CS payment. 3) in NM a CS modification can only be approved if there's a "material change" (20% I think) in the calculation....so neither side tries to modify every time the other parent has a garage sale or gets a $500 bonus or whatever.

I don't know if you're getting ripped off or not. I have two kids, my ex makes about 130k and I make $110k, I have 8 overnights a month and pay $1060 a month. A lawyer can tell you. Also, don't take whatever numbers your ex comes up with for granted. My ex tried to con me into paying an extra $400 a month last year until my lawyer shut that down.

I assume you are dad by your screen name. And that you are in Cali. So I hate to say it good fucking luck. CA courts will never do anything to help you. You will have more luck if you change your gender, and claim that you were the wife through the whole marriage.

Seriously though, if you want to reduce your child support the easiest way is to wait until your kids are legal Adults. That’s the only sure fire method. And probably the only one that will show any success in reducing what you pay.

Welcome to the world of dad gets fucked by the system and mom is rewarded. It will not work any other way you have little to no chance. Accept it and pay into the slavery system.

Without knowing your gross, it's hard to say. But yeah, if you have 50% custody and your ex has a decent income, that does seem lopsided. Ideally -- and this is a stretch! -- mom and dad have nearly the same income and 50/50 custody, and therefore no CS money changes hands at all.

Anyway, I wish I had more hopeful news for you. But I've concluded that CS modification is like Bigfoot: some people believe it exists but no one can prove it.

There have been significant changes in my income and my ex's income. Plus, our case is more than three years old (after three years, everyone is ENTITLED, BY FEDERAL LAW for a CS review). I've been to court several times, but in the end, the judges just don't want to hear it. They're not interested. They're bound by duty to hear your case, but I could tell, immediately, they weren't interested in anything I had to say.

Your mileage may vary, obviously. This varies by court and by judge, I'm sure. But my judge made up his mind a long time ago, and THAT was THAT. I appealed, and the other judge simply deferred to the original judge. What judge is going to upset another judge's ruling? In my city, it's a small community of judges and lawyers who all know each other. My lawyer was an outsider.

Plus, there's another can of worms called Title IV-D. If your case is a Title IV-D case, then there is a big incentive to keep your payments as high as possible. That's another story, but it can be a factor. Absolutely no one in government wants to see a Title IV-D case get a reduction in payment.

Here in nebraska,cs can be modified every 6 months. A state calculator is used. If you make 40k a year, the payment is around $550 a month for one child. It doesn't go down much either if the woman makes 80k a year.
