Take it to your own lawyer for advice. The most obvious problem is that you need a specified standard of evidence required to prove infidelity or abuse, and defining what counts as infidelity or abuse in the first place. For example, in the US, "proof beyond a reasonable doubt," "preponderance of the evidence," and "clear and convincing evidence" are all different standards. "Infidelity" also doesn't automatically include sexting or strippers in a court of law.

In the US custody of children is determined for the child's "best interest" and can not be specified in a prenup. A lawyer would be able to tell you about the limitations of clause C in your country, if any. This is essentially never discussed, but as a matter of sexual strategy I do believe most women should refuse custody of most children in a divorce - barring issues involving likely CPS removal from the other spouse - if they are planning on remarrying. Presumably you'd want a similar abuse of children clause exception, if there really wouldn't be any issues enforcing clause C in your country.

Seriously though, this is a sexual strategy sub, not a legal sub, and not your lawyer in particular. There could be many more issues in the whole prenup we would never catch. Do NOT sign a prenup without a lawyer who is working for your best interests taking a look.

though wouldn’t work in the states and could get the whole thing tossed. don’t know the laws where you live so it could be nothing or something to look into.

You 100% need your own lawyer to look at this prenup. And as has been mentioned, make the terms explicit what constitutes “infidelity”.

Additionally - you seem to have a lot of concerns about this relationship, not the least of which is his cheating past and current hypocritical ways. You also posted in another sub that if your relationship (and premarital sex life) were to be discovered, his reputation would be destroyed. Does that sound like a man who makes sound decisions, and has your best interest in mind? Can you genuinely trust this man to lead your marriage in future?

Also, why keep posting if you don’t seem to want to take any of the advice here?

The last clause seems unenforceable and would likely make the whole thing invalid. I would consult with YOUR lawyer, not the one looking out for his interests in case he cheats again.

If you are residing in his country, and that is where the assets and marriage will take place, the laws of your country are irrelevant AFAIK IANAL

Take it. You'll have a roof over your head until you die unless you sell it, and chances are very good you'd get a great price. If you are interested to do so, you may want to inquire about visitation with your children in the event of clause c.

Title: Advice on prenup

Full text: Me and my fiancee are going to get married in December. Due to some circumstances regarding to his past marriages, he arranged me a prenup. After meeting with his lawyer for discussing the prenup and declaration of assets and debts, i get a copy of the agreement and will inform the lawyer if i agree. These are some important clauses:

A.) My husband owns 3 houses and 2 lands. He shall legally hand over one certificate of the house into my possession

B.) The asset for which i am handed over is pledged as collateral in case: - There is a divorce due to infidelity by the husband - Divorce due to verbal, physical or psychological abuse by the husband - A diivorce is filed by the husband - Husband passed away

C.) In the event of a divorce for any reason, regardless of the party filing for divorce, custody of the biological child, if underaged belongs entirely to the husband

For context, i'm not in US and the law of marriage in my country, assets that are obtained pre-marriage isn't split after divorce, hence the prenup he offered as protection and assurance. Any advice or opinion?
