I’ve filed, but my wife and I are still living in the same house with our two kids, mostly to maintain continuity for them. It has been tense. And I feel like at any second, she could ask for a temporary orders hearing that requires me to move out during the pendency of divorce proceedings. My attorney tells me that since I am the moneyed spouse (she is a SAHM), she would probably get this. There wouldn’t be any allegations of abuse, etc.—she would just say that it’s not working for us to be in the same house, one of us needs to leave, and it should be me. And the judge would order that, on a temporary basis.

Here is my question, for those who have gone through this. If I am ordered to leave during the pendency of divorce proceedings, would the temporary orders hearing still give me some custody over the kids, like they would have to rotate to my place according to some sort of schedule? Or would I not have any possession rights? Again, assume there’s no allegations of bad stuff—just that the court ordered me to move out during divorce because the wife says that needs to happen and I have the money to get another place.

I think I’m okay with moving out on a temporary basis if so ordered. But I am NOT okay with not seeing my kids during that time.
