Did your temp orders become final orders?

I am going to find out soon I am curious what your situation was. Was there lying and weaponizing the system involved? How much lying was there?

When you say temp orders, are these something you either agreed to or the judge imposed?

If not, its just a piece of paper with opinions and likely posturing to try to get you to settle for something they know they won't get in court.

Temp orders if they last long enough tend to become the status quo. Exclusive use of the house may or may not happen, but eventually there will be 2 residences anyway. The law almost everywhere doesn't let mom move the kids anywhere in the country at will once divorce is filed.

Mine didn't.

Mine was a unique situation, as I had to move out and had room mates, but the "marital house" as my separate and sole property, but my ex-wife and kids stayed in the house and I told the judge I moved out to "keep the peace."

So my temporary orders were that on Wednesdays and Saturdays at noon, she would have to leave the house and not return until the next day at noon. Plus, since my exwife had a recent conviction for DUI, she had no drivers license and no car, so it was 100% me handling groceries, etc, so I was seeing the kids every day.

At divorce trial, my exwife tried to offer "He can come to my house anytime he wants to, so he can see the kids." But my lawyer and I said, "NO!" to that, we want 50/50 custody, since it was my house anyway and she would be moving once the divorce was final.

The judge granted me my request for 50/50 custody.

nope temp orders are just usually for the children and the least earning spouse and their collective welfare while the divorce proceedings are ongoing.

Final decree is usually a more equal determination

NOW with that said if you have temp orders that are overly generous for one party... why would they need to settle for less? This sets up a very difficult negotiation for final resolution.

I wondered why my lawyer litigated the initial hearing (the one to determine temp orders) like it was a final hearing... turns out everyone has initial hearings... 1 out of 100 have final hearings.

So it does pay to play hard ball on the initial hearing and be prepared for a very contentious hearing.

IF you are in the situation where you did not get an initial hearing to your liking and got temp orders that were not really very nice to you... I would look to get a new attorney and make sure that the next few months/years yield an outcome that is not a generous to the stbx as the temp orders.

They don’t have to. Did they approve her temp orders or is it just what she’s requesting? Judges like to keep the status quo so if the temporary order goes on for an extended period of time, it certainly could make a permanent order more likely. It’s easier to fight the big battles in the beginning rather than having to go back and change things. You should fight for temporary orders that are fair right now.
