It's a communal debt on a communal piece of property. Listen to your attorney, but it sounds like joint funds/ communal funds are fine.

In my case, I worked in the x did not. Due to a bunch of sales. We owed about $45,000 to the IRS at the time of the divorce/separation. She did not want to pay half of that.

Her brief argument was that since I'm the only one working, I'm the only one that's responsible for the tax bills. To which of course my response was. Since I'm the only one working, I should also have access to 100% of all equity and property. She never responded to that.

She did ultimately pay the 50% of the tax owed (As a credit during final settlement)

I paid it using post-separation funds. I was told it's part of the equity in the house, but my ex is getting the house, so I doubt I'll ever get reimbursed for it.

I would go with your lawyer's recommendation and pay for it out of a joint account.

Don't take legal advice from your STBX. She isn't an attorney and doesn't have your best interest in mind.

You pay it just like you're paying the mortgage, car loans, etc.

How was it handled before your divorce process started ?

The status quo should remain in place - until the divorce is completed - thats what you need to tell her.

If your going to pay it all - then you need to capture it as a expense and deduct it all her side for the final equalization payment.
