The floor is 40-hours minimum wage in your area.

The ceiling is based on past jobs and university degrees. If she's got degrees or certifications but never had a related job, or is underemployed, then pay to have a vocational evaluation performed. It's worth the cost in the long run because it will lower your spousal/child support payments.

Brother, whether 30 hours of imputed income is reasonable depends on your ex's work history, education, skills, health, and how long she's been out of the workforce, but if she's capable of working part-time and has no legitimate reason not to (like disability or primary caregiver responsibilities for young kids), then yes, 30 hours is absolutely reasonable to request and most judges will impute at least part-time income if she's voluntarily unemployed or underemployed. The key is proving she's capable of earning that income based on her qualifications and the local job market, so bring evidence of her education, past employment, available jobs in the area that match her skill set, and any documentation showing she's choosing not to work rather than unable to work, because courts don't reward people for voluntarily sitting on the sidelines to inflate support obligations.

We never saw a judge. We did mediation/arbitration. Our proposal when we finally crossed the magic 40/60 custody threshold after a few years out was to inpute min wage at 40 hrs (she had a double major in business/marketing). The night before her lawyer suddenly sent a letter that she got a job offer from her boyfriend to manage his clinic 20 hrs a week at double min wage so same amount. Done! Except we inputted that amount immediately (not the following year) and escalated a few thousand every year for next 5 years so she couldn't just sit on that amount. It will be inputted or real amount whichever is higher. A bit of minor tweaking to amounts but ultimately accepted so we didn't have to keep having stalemates and coming back to the table again and again. Very little goes to courts in Canada, especially during and following COVID

30 hours at min wage after 4 of her lawyers, 8 discoveries, and 3 different judges (one diagnosed with Alzheimer's) and that took my payment down about $400 to $4825. No kids.

They only impute income on men. 40 hours of part time work would reduce your alimony and child support by $200 a month.

This racket is not meant to be fair, every borderline issue will break against you.

Your best bet is to negotiate with your ex and keep “family court” far far away from you.

To negotiate effectively you hide your own desires and tailor your proposals to your ex’s desires. Reverse psychology, misdirection, fake one minute apology are some good angles to get out with your future cash flow in tact.

Just my opinion of course.

Studied the family court racket enough to understand its purpose and goals are not aligned with yours.

I got off easy by playing on ex wife’s greed. It was a much simpler and more direct path than hoping to be treated fairly in family court.
