I would remind you that in the United States, marijuana is a Schedule 1 substance under the Controlled Substances act. It is illegal. I would also remind you that, with the exception of South Dakota, every single state legislature and governorship (and emperorship, in Illinois) has an oath requiring obedience to the Federal government (this is explicitly required in the US constitution, meaning South Dakota isn't actually a state, but that's small potatoes here). Does that mean all these elected officials have violated their oaths of office? Yes. Yes, it does. And while I don't have information on every oath taken by police officers in every jurisdiction in the 24 states that've said "Nah, we're not going to bother enforcing federal law", odds are, most of them have, too.

Now, if you're going to make exceptions, then it should be for a critical issue- something like "people will die if we don't overlook this" in the midst of some terrible crisis. "Some folks just wanna get high" is not a terrible crisis.

So this woman stole drugs from her boyfriend and consumed them, and then, under the influence of illegal drugs, MURDERED him, and... gets 100 hours of community service? Even after also trying to stab her dog and herself?

Do we even have laws at all any more?

If an adult drinks and drives we hold them responsible for any harm caused. Why would this be any different? If we held people responsible for their actions “while under the influence” of anything that alters their mind, we might get more responsible behavior. Women need to be held to the same standard as men across the board.

I don't for a second believe that weed made her do it. Could there be some other psychiatric condition that was inhibiting her decision making abilities? Quite possibly. In that case though, the proper sentence is to be confined to a psychiatric facility until such time that the underlying condition can be adequately treated so that she is no longer a threat to the community. Not, "oh, well you weren't actually responsible, so off you go, be good now."

Actually, let me reconsider what I said, if two hits off a bong was enough to put her in a state to kill without fully intending it, she definitely has some underlying psychiatric condition that she should be confined for until it is adequately treated.

Potheads don’t like to admit it but people who smoke regularly in their teens and twenties have a high incidence of schizophrenia and psychosis. But that’s not what they argued in this case, it was the first time she ever smoked and she took an incredibly high dose; it was 38% THC. Even if you smoke a lot that is not something to mess with.

The prosecution didn’t question it because there were so many witnesses that it was clearly a real psychotic break. She stabbed herself repeatedly, her dog, the police tasered her 4 times and she still kept stabbing herself, a total of 43 times. They had to hit her arm with batons, 9 times, and break it before she dropped the weapon. The boyfriend’s roommate witnessed everything from the beginning. There were 4 expert witnesses, defense, prosecution and 2 independent (appointed by the judge). All 4 agreed on the diagnosis.

There are many examples of men killing family members during psychotic breaks and being sentenced only to psychiatric care. The unusual feature in this case is that the woman was a first time user and does not have residual effects of the psychosis. In past cases the men typically smoked daily and after the episode they had lifelong schizophrenia with the possibility of further psychotic episodes.

Cannabis induce psychosis happens. Not always and not to everyone, but it happens to a few.

Happened to a guy in Florida who took cannabis, then tackled a tourist and chewed part of his face off. I remember it was reported in the news a while back.
