Exactly. My ex wife is milking the piss out of me in child support. Working "kind of sort of" part time when she feels like it, but living it up in an expensive rental, taking lots of little trips and vacations and so on.

I complained to my attorney that none of the money was going to my son. He laughed at me. Said the courts don't care and there's nothing that can be done about it.

What a joke society we live in. How can any child, under any circumstances, cost $192,000 a year. Keep in mind child support is not taxed so its roughly equivalent to a $260,000 income. And here's the kicker, the other spouse doesn't even get to deduct that from his income. Essentially he pays the taxes on that. Source: my father.

There needs to be a flat calculation for the cost of a child (indexed to inflation) for support purposes. Any other method is insanity.

It needs to be capped at a lower-class bare minimum level, no matter how rich the parent is. If the parent wants to give more? Great. If not? Your parent's a greedy piece of shit--sorry about your luck. Also a lot of child support paying father's dont even get visitation rights even if they want to be involved in their kid's life. This could be a good bargaining chip in ensuring more joint or shared custody arrangements (which typically do not involve formal child support)

Not entirely true, Joint custody means that you have to split the major decisions in a child's life( IE, religion, medical, school...). That is ALL custody is, the child support comes in on the amount of overnights one child spends at another. I know for a FACT that KS and OK still make the non custodial parent pay child support, especially if that custodial parent makes a large sum more than the custodial parent.. I should know because I have joint custody of my son and I'm paying 500 a month + carrying medical insurance on him or roughly around 650 a month.

When I got divorced, I was unemployed and had just ran out of unemployment benefits. My income was zero, my ex was still making $65k. I still had to pay $300/mo on zero pay.

They may tell you what the custodial makes is figured in, but if the custodial is a woman, all bets are off.

That's what I implied when I said "[t[here needs to be a flat calculation for the cost of a child." Essentially they should figure out the cost of a child in your jurisdiction (perhaps based on the consumer price index) and assign that as the child support in all cases. Of course there should also be a cap based on percentage of total income of the paying spouse.

There wouldn't be any need to do that if the law simply allowed people to have child support cut if they can show their partner is not spending it on the child. Oh you are using 2k of those 16k to pay for your luxury car? good, it means they are not going to your child and thus you don't need them.

Oh and if you keep doing that shit, showing that you don't care about your child and won't spend the money allocated to them on them? then you are not fit to be a parent you greedy fuck, and custody should go to the other parent.

Wait... Person A makes a salary, pays taxes on that money, transfers a percentage to Person B as child support and Person B also pays taxes on that money? That's just messed up. Unless the child support is going to a person in a higher income bracket, I guess. Still pretty messed up.

It shouldn't be taxed twice. Contributing spouse should receive a tax write off (considering he essentially gave the money away akin to a charitable contribution) and the receiving spouse should pay taxes on her new "income".

Sorry, it's not taxed twice. The person paying support gets taxed on it, the person receiving it pays not tax on it. The opposite of alimony, which is taxed as income to the receiver. As we are seeing less alimony awarded, we are seeing more child support, probably because of this and because alimony doesn't last as long anymore, and child support is guaranteed up to 18 years.

The person receiving the support also gets a deduction on their taxes for dependants.

Like, I pay 600 a month, after taxes, and can claim nothing on income taxes. She gets it all tax free, claims the child as her dependant, and gets about a $5k tax refund every year.

How is this fucking legal.

That's right, I forgot about that. I pay her the support, and instead of her paying taxes on it she takes the child tax deduction. I think we're supposed to alternate years with that, though I'm not entirely sure.

There is a flat calculation. The thing is, if the kid is born to rich parents, the calculation is large to begin with. The calculation isn't so much of the cost of the child so much as it is the standard of living for the child of wealthy parents. Rich parents live in mansion? Kid is worth a fraction of the mansion since kids live somewhere. Rich parents drive a $100K car? Kid is worth a fraction of that since kids are driven around. It doesn't extend to stock options but you get the idea.

The real problem for hollywood types is that their income can drop so much and the child support money isn't automatically pegged to fluctuating income.

Married men should get custody of there children if they (the men) are not in jail. Children born to unmarried women should belong to the mother. There should be no common law marriage. Anything less snd men are getting ripped off.
