From my experience only if you want to push it and even then depends on the judge. My wife didn’t even submit hers and my lawyer didn’t think there was much we could do. I made all the money, so I doubt it would have mattered. If you do end up in front of a judge or mediator, you could press for a statement over the last 30 days.

Mention this to your lawyer. The affidavit did not ask you to declare some of your finances. Also, the one I signed said it was under penalty of perjury. The truth, the whole truth and nothing but the truth is pretty clear. Lying by omission is lying.

Don't roll over. Not only is she probably counting on you to do so, you'll regret at least not asking. Have some self-respect and raise a fuss about it... it's the truth, ain't it? And what would she do to you if the roles were reversed?

Your location will matter. Do you know how she acquired said money? Any income or money is that spouses acquire AFTER separation in states like California is theres alone. My ex wife received a wind fall from her parents to get on her feet, which I had no entitlement to after she left me.

Depending on how much that is, it could end up saving you lots of money if the court knows it exists.

The answer is "maybe". If she doesn't disclose it and you provide evidence that she lied on the form, then it's up to the judge to penalize your STBXW for lying on the form.

My exwife desperately tried to play the "I'm too sick to work" card and she conveniently left off her previous year's income information.

Three months before our divorce trial, when I did the 2016 taxes, we had filed married/jointly. She wouldn't give me her W2. So she sent me a crooked cell phone pic of her w2 so I could file the taxes.

Well, I submitted that cell phone pic of her w2 as evidence that she could work. Up on the stand, she and her lawyer didn't go over the exhibits. As soon as my lawyer brought out "exhibit 12", he said, "as you can see here, we have a w2." Her lawyer immediately stood up and said, "I object! We don't know whose W2 that is." I nudged my lawyer and pointed to her SSN on that w2. My lawyer said, "In box 2, is that your SSN? In box 1a is that your name? In box 6 is that the place you worked at?" The judge looked at my exwife and said, "You will answer the question." My exwife admitted that it was her W2 from when she was working.

Alimony? The 50% of my take home pay she demanded because she was too sick to work? DENIED! $0!

She said the $1500 was help from her grandpa for legal expenses and other needs, that was her reasoning for not disclosing it.
