You'll need to talk to an attorney familiar with your state of residence. It will differ from state to state, but the answer will likely be no. 401k contributions don't matter in the calculations in my state (not PA). They look at gross earnings.

I have been left with 34% of gross income before my 401k and 20% after 401 k deductions. I can't write off the $ I give her, and she won't pay taxes on her "income" (spousal support). No kids either. I'm getting robbed.

Also in PA. It’s gross income. And a gross lack of common sense. They’ll reduce the support by anything you pay on behalf of mom and kids eg auto/health insurance, tuition etc. sounds like you’re in the beginning stages. Prepare yourself for a level of corruption so conspicuous it’s hard to comprehend. PA is a presumptive 50/50 state so there’s that at least. Best of luck.

It’s gross not net. So it’s your income before all the taxes, 401k contributions, health insurance contributions get taken out.

In my state it goes by salary, minus what the other person makes, and spits out a number through some sort of formula.

No, your 401k or HSA contributions will NOT reduce your obligation. It is this way to keep people from artificially reducing their income to pay less.

It keeps someone from maxing out their pre-tax contributions, finalizing the divorce, then going back to some lesser contribution.

That's good to hear. Therapy may also work if you can find the right therapist. The only reason why I didn't go, was that I had moved out from my stbx back in 2012 - 2013, and I went to singles couples and group therapy with her. She seemed to learn things but then went back to her old ways about a year later. Therapy takes 2 people. I didn't learn much in therapy, but I thought it was good for her. It turns out she didn't learn anything. In the case where it's just you and she is out of the picture, I'd say it can be of great benefit.

No, 401k contribution does NOT impact your child support obligations.

If you are covering health insurance for the kids, you will get a credit for that. PA does take in to account taxes in their calculations. The state has a site which you can enter your numbers in a s get an idea of what to expect.

If your Ex is not working and is capable, there will be an assumed/imputed earning potential for them. This will be debatable. You can enter an agreement outside of court or in mediation, and not need to actually have a trial, if possible.
