Read the IRS fine print.. It states that the money is PER PERSON. The IRS is expecting some of that money earmarked for her to go to her and you keep yours. She legally stole money from YOU the first time around. You should either A) Do the right thing and give her her portion, or B) Keep per portion and make damn sure you have documented you never got your portion at round one and thats why you are keeping round two portion.

Now for the kids,.. If nothing is stated in the divorce decree, you should do the right thing and split it 50/50 but its up to you. I don't have anything in my divorce decree and my ex is trying to fuck me out of it with our kid (it was deposited into my bank account) but I am holding firm and stating that I will split it 50/50 or I am just sending her her $600 portion.

I did the same as you when I figured we would get 2nd checks and made it deposit into my bank account as I have been the more fair human being than she has as she has tried to fuck me over financially the entire divorce. If it went to her bank account, id never see a dime of it.

3400 + 2400 = 5800

Over the 2 cheques u should have had 2900 each. U got 2400 and she got 3400. If she gets arsey asked her what happened with your half of the first cheque. And let her know that she technically owes u 500 but ur alrite to let it go.

Surely she has to report the 3400 on her finance form as well?

If she didn’t give you the half you were owed the first time around, I certainly wouldn’t give her half this time. Make sure you have it documented though.

This is such a great topic. This is why it is so important to know the law. Don’t give anything up guys. Before I start I just want to say in not a lawyer but stood strong on this when both my own attorney and my exes attorney were trying to get me to give this up.

As the law has been written the money is supposed to go to the parent of the I dependent child. Now most are splitting this so technically you should be able to easily split this money with no issues. The issue comes if you’re like me. If no agreement can be reached the parent with 50 percent +1 or more custody is entitled to claim ALL independents. If you have anything less than 50 percent custody you don’t have much legal standing. Maybe they’ll still do ‘the right thing’ but yeah good luck with that. If you split custody 50-50 like I do then parent who makes more money is entitled to claim any and all of independents. The money is technically yours. I still split the money even though I didn’t have to. Why end up back in court right?

If you have an an attorney you should ask them.

If not, and you are not in desperate need of the money, I'd recommend giving her 50%. You want to make a good impression on the judge. Who is more trustworthy, fair, honest, reasonable... you get the point.

keep the money and spend it the way you see fit...think about it 6700/2=3350, that is what each person is supposed to get right? If this is the case than she still owes you money.
