This almost happened to me under very similar circumstances. I now pass on my advice to injured people in this situation.

Before a personal injury payout, get divorced if you need to. That way the divorce lawyer can protect your rightful injury settlement from the green eyed monster, money can turn onlookers into monsters.

I "walked" away with everything and can sleep at night knowing there can't be a future claim from my ex on my assets or cash. This is backed up by a judges signed contract between my ex and I.

She's still bitter but at least what mine stays mine and hers stays hers.
